<br />KNOW ALL MEN BY THESE PRESENTS, that BURLINGTON NORTHERN RAILROAD COMPANY (formerly
<br />named Burlington Northern Inc.), a Delaware corporation, Grantor, for One HundredSixtyu
<br />One Thousand Five Hundred and No/IOO Dollars ($161,500.00), to it duly paid, the receipt
<br />whereof is hereby acknowledged, has granted, conveyed, remised, released and
<br />quitclaimed, and by these presents does grant, convey, remise, release and forever
<br />quitclaim without any covenants of warranty whatsoever and without recourse to the Grantor,
<br />its successors and assi ans. unto GRAND ISLAND INDUSTRIAL FOUNDATION, INC., a
<br />Aie~r4s,l:;:A corpo~ation, of 309 West 2nd Street, Grand Island,-Nebraska 68802,
<br />Grantee, and to its successors and assigns forever, all its right, title, interest,
<br />estate, clil.im and demand, if any, both at law and in equity, of, in and to the following

<br />All that part of the West Half of the East Half of the Southwest
<br />Quarter (Wt Ei SW!) of Section Four (4), Township Eleven (11) North,
<br />Range Nine (9) West of the 6th P.M., Hall County, Nebraska, lying North
<br />of Grantor's 100 foot wide right-af-way, as now located and constructed,
<br />being 50 feet wide on each side of the main track centerline, ALSO
<br />
<br />A tract or parcel of land in the East Half ot the Southwest Quarter
<br />(E$ SWi) ot said Section Four (4) described as follows:

<br />Begninning at the intersection of '-e we~t line ;,' the East Half of the

<br />Township Eleven (11) North, Range Nine (9) West of the Sixth PrinCipal
<br />Meridian, and the Northerly line of the right-of-way of the Chicago,
<br />Burlington & Quincy Railroad Company, thence Northerly along said West
<br />line of the East Half of the East Half of the Southwest Quartei'
<br />(Et Et SWi) of Section Four (4), a distance of 300.0 feet to a point;
<br />thence Southeasterly along a straight line which makes an angle of
<br />30 degrees 35 mi nutes, measured counterc 1 ockwi se frQ;ll the 1 ~s t-describcQ
<br />course, a distance of 423.45 feet to a point on the Northerly line of
<br />the right-of-way of said Railroad Company; thence Northwesterly along
<br />said railroad right-af-way line being the arc of a circular curve concave
<br />Southwesterly that has an initial tangent which makes an angle of 41
<br />degrees 16 minutes 10 seconds, measured counterclockwise from the last-
<br />descr-ibed course, d radiu~ of 2914.93 feet, and a central angle of
<br />1 degree 51 minutes 50 seconds a distance of 94.83 feet to a point;
<br />thence continuing i'iorthwesterly along said railroad right-at-way line
<br />being tangent to the curve in the last preceding course described, a
<br />distance of 130.09 feet to the Point of Beginning.

<br />SUBJECT, however, to all existing interests, including but not limited to
<br />311 f'eservations. rights-oi-way and easements of record or otherwise.

<br />EXCEPTING AND RESERVING, however, unto said Grantor, its successors and
<br />assigns, a11 of the coal, oil, gas, casinghead gas and all ores and minerals of every
<br />kind and nature underlying the surface of the premises herein conveyed, together with
<br />the full right, pl"ivilege and I icense at any and all times to explore, or drill for and
<br />to protect, conserve, mine, take, remove and market any and all such products in any
<br />manner which will not damage structures on the surface of the premises herein conveyed,
<br />together with the right of access at all times to exercise said rights.
