84- 005071 GIM and CM wish to ensure that CM and its successors and assigns, for so long as the Mortgage remains outstanding and unsatisfied, will continue to have, access to the Unreleased Portion across the Released Portion. NOW, THEREFORE, the parties agree as follows: 1. For and in consideration of $10.00 and and valuable consideration, CM hereby grants to GIM, cessors and assigns forever, to the extent of CM's interest therein, and subject to the construction being built and to built on the Released Portion, (a) a non~exclusive perpetual_ ap~ pur tenant easement across the Unreleased Portion for the bene- ~-~ +- of the Released Portion fc;r the pu~pu5e of access DY a-p.y and all parties to the Released :r ci~un, (b) :.. non-exclusive perpetual appurtenant easement for GIM and its tenants, licen- sees, invitees, customers and agents for access, ingress and egress to and from parking areas on the Released Portion and (e) such temporary construction easements as are necessary for pur- poses of constructing the improvements and parking facilities and installing utilities to be located on the Released Portion. 2. For and in consideration of $10.00 and other good and valuable consideration, GIM hereby grants to CM, its succes- sors and assigns, for so long as the Mortgage remains outstand- ing and unsatisfied, and subject to the construction being built and to be built on the Released Portion, a non-exclusive ap- purtenant easement across the Released Portion for the benefit of the Unreleased Portion for the purpose of access by CM, its successors, assigns and their designated representatives to the Unreleased Portion. 3.
