<br />EASEMENT
<br />
<br />RICHARD S. SMITHSON and JUDY L. SMITHSON, husband and
<br />wife, tenants in common, herein called "Grantor," whether one
<br />or more, in consideration of One Dollar {$l,OOl, and other good
<br />and valuable consideration, receipt of which is hereby acknow-
<br />ledged, and of the further agreement herein stated, hereby
<br />grants and conveys unto Town & Country Realty of Grand Island,
<br />Inc., herein called the "Grantee," a permanent and perpetual
<br />easement and right of way to survey, construct, reconstruct,
<br />relocate, inspect, repair, replace, extend, remove, maintain
<br />and operate thereon, a fence and other equipment and necessary
<br />appurtenances upon, along, across, underneath and through the
<br />tract of land and real estate described as follows:

<br />The Easterly 4.8 Feet of Lot Seven (7), in Fractional
<br />Block Twelve (12l, in Gilbert's Addition to the City
<br />of Grand Island, Hall County, Nebraska.

<br />Grantee shall have the right of in?~ess and egress across
<br />Grar..tor I s property for any pur;Jose nec~~ . ary in connection
<br />with the survey, construction, reCOI :ruction, relocation,
<br />inspection, repair, replacement, extension, addition to, mainten-
<br />ance, o~eration, and removal of said fence. Such ingress and
<br />egress shall be exercised in a reasonable manner.
<br />
<br />Grantee hereby agrees to pay the Grantor or Lessee, as
<br />their interest may appear, for any damage to real or personal
<br />property, by reason of the sllrvey, construction, reconstructidn,
<br />re location! L nspect,ion, repa i r, replacement, extension I' addition
<br />to, maintenance, operation, and removal of said fence.

<br />It is fur~her agreed that Grantor has lawful possession
<br />of said real estate, good right and lawful authority to make
<br />such conveyance and that his or their heirs, executors, adminis-
<br />trators, successors, and assiqns shall warrant and defend the
<br />same and will indemnify and hold harmless Grantee forever against
<br />the claims of all persons whomsoever in any way asserting any
<br />right, title or interest prior to or contracty to this conveyance.

<br />Block Twelve {121, in Gilbert's Addition to the City of Grand
<br />Island, Hall County, Nebraska, and this easement shall be
<br />used in connectIon with the ownership of such lot and shall
<br />be perpetllal and run with the land.
