MATTKE, herein called the <br />Mortgagors, in consideration of Five Thousand six Hundred <br />Fifty-Six and 62/100 Dollars, ($5,656.62), do hereby mortgage to <br />MELVIN K. PATTERSON and DOREEN P. PATTERSON, husband and wife, as <br />joint tenants with right of survivorship, herein called the <br />Mortgagees, the following-described real estate situated in Hall <br />County, Nebraska, to-wit: <br /> <br />The easterly Seventy-One (71 J feet of the northerly <br />Sixty-Six (66) feet of the following described tract of <br />ground, to-wit: Fractional Lots One (1) and Two (2) in <br />Fractional Block Two (2) in Russel Wheeler's Addition, <br />and of their complements, to-wit: Fractional L~ts One <br />(1) and Two (2) in Fractional Block One Hundred Twenty~ <br />Five (1251 in Union Pacific Railway Company's Second <br />Addition, boton being Addition to the City of Grand <br />Island, Nebraska, and being a rectangular tract of <br />ground having an easterly frontage of Sixty-Six (66) <br />feet on Locust Street in said City, a depth of seventy- <br />One (71) feet f and bounded on the North by Eighth <br />Street, in said City, in Hall County, Nebraska. <br /> <br />The Mortgagors do hereby covenant with the Mortgagees and <br />wi th Mortgagees' heirs and assigns tha ~ Mortg-agors are lawfully <br />seized of said premises, that: they aJ .: free from encumbrance, <br />that Mortgagors have good r1.:1t and lawful authority to convey <br />the same, and that Mortgagors warrant and will defend the title <br />to said premises ,'l.gainst the lawful claims of all persons <br />whomsoever. <br /> <br />This Mortgage is a first purchase money l1IOrtgage given to <br />secure the payment of the principal sum of Five Thou...and Six. <br />Hundred Fifty-Six and 62/100 Dollars ($5,656.62) and interest <br />thereon, according to the terms of a certain Promis$Ory Note of. <br />even date, executed by the Mortqllgors to the Mortgagees, due the <br />1st of August, 1989, the terms and conditions of which Note are <br />incorporated herein and made .;l part hereof by this referenoe. <br /> <br />The Mort<Ja<Jors aqree to pay all taxes and assessments Ul'On <br />sa id premises - and all' other taxes, levies and asse.ssmEtJlts. levleq <br />upon this Mortgage and the Note which this Mortgage is. given to <br />secure before the same becOltle delinquent. !n the event the <br />Mortgaqors !lhall fail to pay such taxes before. delinquent, the <br />Mortgagees mllY pay such taxes or other liens and shall have a <br />lien secured hereby for the lUllount so advanced with int.et:est <br />thereon at the m<lxilllum legal rate. <br /> <br />In the event the Mortgagors default in the payment of said <br />indebtedness or any installment thereof or fail tomalte payment <br />of taxes before the same become delinquent or fail to perform any <br />of the other agreements herein, the Mortgagees at their elect.ion <br />may declare the entire debt secured by this Mortgage to be due <br /> <br />-1- <br /> <br />lJo <br /> <br />L <br /> <br />L <br /> <br />-.J <br /> <br />L <br />
