<br />I <br /> <br />84"- <br /> <br />002895 <br /> <br />r <br /> <br />NOW, THEREFORE, in consideration of the payment of One Dollar <br /> <br />($1.00) and in further consideration of the mutual covenants herein <br /> <br />contained, the parties agree as follows: <br /> <br />1. That the Parties of the Second Part do hereby acknowledge <br /> <br />and admit that the true boundary line between their property and the property <br /> <br />of the Parties of the First Part is the boundary line as shown upon the <br /> <br />survey which is attached hereto and made a part hereof by this reference. <br /> <br />2. That the Parties of the First Part do hereby acknowledge <br /> <br />that the Parties of the Second Part may, without further license, have the use <br /> <br />and enjoyment of all that portion of land owned by the Parties of the <br /> <br />First Part which lies south of the presently existing fence, as is shown <br /> <br />upon the survey which is attached hereto and made a part hereof by <br /> <br />reference a <br /> <br />3. That this license and its burden and benefit are intended <br /> <br />to attach and run with the premises of both parties hereto, respectively, <br /> <br />and their heirs, assigns, transferees, predecessors and grantees in title~ <br /> <br />4. The duration of this License Agreement shall be for the <br /> <br />natural life of the presently existing fence and metal shed. In the <br /> <br />event that the presently existing fence shall be damaged or destroyed <br /> <br />to the extent of 50% or more of its value by fire, wind, flood or other <br /> <br />natural cause, the license shall cease to exist and is terminated. Should <br /> <br />the metal shed be damaged or destroyed to the extent of 50% or more <br /> <br />of its value by fire, wind, flood or other natural cause, the license shall <br /> <br />cease to exist and is terminated. The liability for upkeep and maintaining <br /> <br />the fence and metal shed shall be at the sole expense of the Parties of the <br /> <br />Second Part, <br /> <br />-2- <br /> <br />u <br /> <br />L <br /> <br />L <br /> <br />.-J <br /> <br />L <br />
