THIS MORTGAGEIDEED OF TRUST MODIFlCA nON AGREEMENT made and executed this J j*'.h-of NOVEMBER. 2008, by and between HAROLD C MEDLEN AND JACQUELINE B MEDLEN. HUSBAND AND WIFE hereinafter referred to as "Borrower", and HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, hereinafter referred to as "lender", WITNESSETH: WHEREAS, Borrower did execute a certain Deed of Trust dated OCTOBER 6. 1999. filed of record on OCTOBER 12.1999 in the HALL COUNTY REGISTER OF DEED'S OFFICE OF HALL COUNTY, NEBRASKA in DOCUMENT #0099109968~ ALSO a Deed of Trust Modification Agreement dated September 18, 2003 and recorded October 17, 2003 as Document # 0200313793; ALSO a Deed of Trust Modification Agreement dated April 20, 2005 and recorded April 26, 2005 as Document # 0200503708; ALSO an Extension Agreement dated September 18, 2003 and recorded October 17, 2003 as Document # 0200313792; ALSO a Deed of Trust Modification Agreemetn January 19,2007 and recorded January 25,2007 as Document #0200700623; AND a Deed of Trust Modification Agreement dated September 14, 2007and recorded September 24,2007 as Document # 0200708177; described as: THE WESTERLY TEN (10.0) FEET OF THE EASTERLY (40.0) FEET OF LOT EIGHfEEN (18), BLOCK THREE (3), BLAINE ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNlY, NEBRASKA; TIlE WEST TEN FEET OF LOT EIGHTEEN (18) AND ALL OF LOT NINETEEN (19), IN BLOCK THREE, BLAIN ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. WHEREAS, such Deed of Trust does not contain a provision regarding a right to future advances to be secured by such Deed of Trust; WHEREAS, Borrower has requested that Lender make an additional advance to be secured by such existing Deed of Trust; WHEREAS, Lender is willing to make an additional advance to be secured by such Deed of Trust provided there shall have been no filings of record subsequent to the date of the recording of that Deed of Trust hereinabove identified; WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust identified hereinabove to provide that it shall continue to secure the presently remaining indebtedness and the additional advance and future advances from and after the date hereinafter specified; NOW, THEREFORE, it is agreed: I. Incollloration of Future Advance Rights. From and after the date of the execution of this Deed of Trust Modification Agreement, the indebtedness secured by the Deed of Trust described hereinabove shall secure advances made concurrently herewith and future advances in accordance with the following provision which shall hereafter be deemed to be a part of such Deed of Trust: Future Advances. Upon request of Borrower, Lender may, at its option, make additional and future advances and readvances to Borrower. Such advances and readvances, with interest thereon, slu\}l be secured by this Deed of Trust. At no time shall the principal amount of the inde~tedness secured by this Deed of Trust, not including sums advanced
