An executed copy of this Agree-" ... <br /> <br />ment, the Abstract of Title, together with a Warranty Deed, Trans~ <br />fer Statement, and Bill of Sale conveying the premises and all <br /> <br />Air <br /> <br />personal property to the Second Party shall be deposited with said <br /> <br /> <br />Escrow Agent on said Closing Date. Closing will be at the,offices <br /> <br />of Central Nebraska Realty, Grand Island, Nebraska. UpOll payment: <br /> <br />of all principal and interest due to the First Party and theper~ <br /> <br />formance of all terms and conditions of this Agreement by the <br /> <br />Second Party, the Second Party shall be entitled to delivery of <br /> <br />said Abstract of Title, Warranty Deed, Transfer Statement and <br /> <br />Bill of Sale. First Party shall pay the documentary tax as may <br />be required by law not to exceed $71.50 when the Warranty Deed is <br />delivered. It is agreed that the duties of the Escrow Agent are <br /> <br />as a depository only, and said Agent shall not be called upon to <br /> <br />construe this Agreement or any relaced document. In the event <br /> <br />of any dispute between the parties, the Escrow Agent shall have <br /> <br />the right to hold the above described documents until such time <br /> <br />as a mutual agreement has been reached by the parties Or adjui- <br /> <br />cated in Court. Escrow fees shall be shared equally by the parties. <br /> <br />10. First Party agrees that conveyance of the premises to <br /> <br />Second Party shall be by \>iarranty Deed, free and clear of all liens <br /> <br />and encumbrances, except for existing leases, easements of record <br /> <br />and restrictive covenant~ of record. Any mortgage on the premises <br /> <br />shall be paid off by First Party before delivery of the Deed is <br /> <br />made by the Escrow Agent to Second Party. <br /> <br />11. Upon request of either party. both par,ies agree to cxc- <br /> <br />cute a notice of this sale for recording with the Register of Deeds. <br /> <br />12. All risk of loss or damage to the premises and improve- <br /> <br />ments thereon by reason of fire, wind or other casualty. shall rest <br /> <br />with the First Party untIl closing. First Party agrees to continue <br /> <br />L <br /> <br />to keep the premises and improvements insured as they now are up to <br /> <br />closing date.
