<br />84__' 002476 <br /> <br />AMENDMENT TO <br /> <br />r <br /> <br />SUBDIVISION AGREEMENT <br /> <br />GRAND ISLAND MALL FIFTH SUBDIVISION <br /> <br />In the City of Granrl r~land, Nebraska <br /> <br />THIS AGREEMENT made the date below written to amend the <br /> <br />Subdivision Agreement dated April ~, 1984, between the parties. <br /> <br />In consideration of exchange of proeprty, paragraph 7, "Land <br /> <br />Exchange" of the aforesaid Subdivision Agreement is hereby amended <br /> <br />to read as follows. <br /> <br />.7. Land Exchange. Grand ISland Mall, Ltd., agrees <br /> <br />to grant a storm detention cell easement to the City or' Grand <br /> <br />Island over and upon Lot Seven (7) of Grand Island Mall Fifth <br /> <br />Subdivision. Grand Island Mall. Ltd.. agrees to develop <br /> <br />said lot as an extension of the adjacent storm sewer cell <br /> <br />to the City's spec~tications. <br /> <br />[n consideration of the fore- <br /> <br />going, the City shall title to Grand Island ~:all, Ltd., Lots <br /> <br />5 and 6. Grand Island Mall, Ltd., shall have the rights <br /> <br />to all material excavated from Lot 7 and shall place suff~cient <br /> <br />fill in Lots 5 and 6 to realign the access road with Overland <br /> <br />Drive entering State Street from Conestoga Mall.
