City shall indemnify and hold GlM, its partners, <br />officers, agents, servants and employees harmless frL,' and <br />against all losses, damages (including loss of use), expenses <br />(including attorneys' fees and disbursements), demands and <br />claims in connection with or arising out of any injury or al- <br />leged injury to persons (including death) or damages or alleged <br />damages to property, or the use thereof, sustained or alleged <br />to have been sustained in connection with the Retention DitCh, <br />the maintenance thereof, or the use of the Parcel by City for <br />any reason whatsoever. City shall defend any suit or action <br />brought against GlM, or any of its partners, officers, agents, <br />servants or employees, based on such alleged injury or damage <br />and shall pay all damages, judqrnents, costs and expenses, in- <br />cluding attorneys' fees and disbursements in connection with said <br />demands and claims resulting therefrom. <br />4. The Obligations and agreements contained herein <br />and the easements granted hereby shall be covenants andea.e- <br />ments running with the land and shall be binding upon and inure <br />to the benefit of the parties hereto and their respective suc- <br />cessors and assigns. <br />5. Upon abandonment of the uses set forth in para- <br />graph 1 hereof for which this easement has been granted, this <br />easement shall be null and void and all rights and interests <br /> <br />L <br />
