<br />THIS INSTRUMENT, made this ~ day of December 1983, by and
<br />between CHARLES F. FAIRBANKS~ Sherlff of Hall County, Nebraska,
<br />and COMMERCIAL NATIONAL BANK AND TRUST COMPANY, A National Banking
<br />Association.

<br />WITNESSETH:
<br />
<br />WHEREAS, the District Court of Hall County, Nebraska, on
<br />the 71i( day of September 1983, ordered, adjudged, and decreed
<br />in a certain case pending in said Court, being Case No. 81-253,
<br />entitled Commercial National Bank and Trust Company vs. Argo Develop-
<br />ment, Inc., et al., that the premises mentioned and set forth
<br />in the pleadings in said cause be sold by or under the directions
<br />of the said Sheriff at public auction in the County where the
<br />said premises directed to be sold are situated, the said Sheriff
<br />first giving public notice of the time and place of said sale
<br />according to law and the practice of the Court, and
<br />
<br />WHEREAS, the said Charles F. Fairbanks, Sheriff as aforesaid,
<br />in pursuance of the order and decree of the Court, did on the 15
<br />day of November 1983, sell at public auction in the Courthouse
<br />in the City of Grand Island, Hall County, Nebraska, the premises
<br />hereinafter particularly described, having first given due legal
<br />notice of the time and place of said sale for not less than 30
<br />days immediately prior thereto in the Grand Island Daily Independent,
<br />a legal newspaper printed in said County, together with a brief
<br />description of said premises as required by the order and decree
<br />aforesaid, at which s:lle the premises '.;ere struck off to Commercial
<br />National Bank and Trust ComparlV, the Plaintiff, for the sum of
<br />Thirtv Thousand Dollars ($30,OUO), that being the highest sum
<br />bid therefore. and
<br />
<br />WHEREAS. the saId salo was alterwards un the I day of December
<br />]YH3, Julv \'xanllned and confirmed by said Court, and' the said
<br />Sheriff w~s then and there ordered ~nd directedbv said Court
