-3- 83- 006589 6. Protection of Beneficiary'sSecurity. Should Trustor fail to make any payment, fail to do any act as herein provided, or if any action or proceeding is commenced which materially affects Beneficiary's. interest in the Property, including, but not limited to, eminent domain, insolvency, arrangements, or proceedings involving a bankrupt or decedent, then Beneficiary or Trustee, but without obligation to do so, and ,...i thout notice to and demand upon Trustor, and without releasing Trustor from any obligation hereunder may make or do the same, and may pay, purchase or contest or compromise any encumbrance, charge, or lien, which in the judgment of either appears to affect said Property; in exercising any such powers, the Beneficiary or Trustee may incur any liability and expend whatever amounts, including disbursement of reasonable attorney's fees, which in their absolute discretion may be necessary. In the event that Trustor shall fail to procure insurance, or to pay any taxes and special assessments, the Beneficiary may procure such insurance and make such payments. All sums incurred or expended by Bene- ficiary or Trustee in accordance with the provisions of this Trust Deed are secured hereby, and, without demand, shall be immediately due and oavable bv 'rrustor, and shall bear interest at the maximum ".llow~ble legal rate; provided however, that at the option of the Beneficiary or Trustee, such sums may be added to the principal balance of any indebteQ~ess secured hereby, and shall bear the same interest as such indebtedness and shall be payable over the remain~ng term thereof. 7. Condemnation. If title to any part of the property shall be 'taken in condemna tion proceedings, by right of eminent domain, or sinnlar dction, or shall be sold under threat of condeI!Ulat.ion, all awards. damages, dnd proceeds are hereby assigned dnd shall be pald to Beneficiary who shall apply such awards, damages and proceeds t.o the sum secured by the T1. :ee, with the f~xceSSr if any, paid t.o the Tru.stor~ 8. Remedies Cu.'llulac.lve. !Ill wmedies provided in this Trust Deed are distinct and cumulative to any other riqht or remedy under chis Trust Deed or afforded by law or equity, and may be exercised concurrently f independen-tly or successively.. 9. Accelerat:l.on; remedies; sale. [Jpon default by Trustor in the payment of any indebtedness-5ecured hereby for the per- forr~ance of any agreement hereunder, 8eneficiary may declare all sums secured hereby immediately due dnd payable by delivering to Trustee a written Declaration of Default. The Trustee shall have the power of sale of property and if Beneficiary desires the property to be sold, it shall deposit with 'rrustee, this Trust Deed and all Promissory ~otes and documents evidencing expendi- tures secured hereby, and shall deliver to Trustee, a written u L ..J L
