<br /> <br />-3- <br /> <br />83- 006589 <br /> <br />6. Protection of Beneficiary'sSecurity. Should Trustor <br />fail to make any payment, fail to do any act as herein provided, <br />or if any action or proceeding is commenced which materially <br />affects Beneficiary's. interest in the Property, including, but <br />not limited to, eminent domain, insolvency, arrangements, or <br />proceedings involving a bankrupt or decedent, then Beneficiary <br />or Trustee, but without obligation to do so, and ,...i thout notice <br />to and demand upon Trustor, and without releasing Trustor from <br />any obligation hereunder may make or do the same, and may pay, <br />purchase or contest or compromise any encumbrance, charge, or <br />lien, which in the judgment of either appears to affect said <br />Property; in exercising any such powers, the Beneficiary or <br />Trustee may incur any liability and expend whatever amounts, <br />including disbursement of reasonable attorney's fees, which in <br />their absolute discretion may be necessary. In the event that <br />Trustor shall fail to procure insurance, or to pay any taxes and <br />special assessments, the Beneficiary may procure such insurance <br />and make such payments. All sums incurred or expended by Bene- <br />ficiary or Trustee in accordance with the provisions of this <br />Trust Deed are secured hereby, and, without demand, shall be <br />immediately due and oavable bv 'rrustor, and shall bear interest <br />at the maximum ".llow~ble legal rate; provided however, that at <br />the option of the Beneficiary or Trustee, such sums may be added <br />to the principal balance of any indebteQ~ess secured hereby, and <br />shall bear the same interest as such indebtedness and shall be <br />payable over the remain~ng term thereof. <br /> <br />7. Condemnation. If title to any part of the property <br />shall be 'taken in condemna tion proceedings, by right of eminent <br />domain, or sinnlar dction, or shall be sold under threat of <br />condeI!Ulat.ion, all awards. damages, dnd proceeds are hereby <br />assigned dnd shall be pald to Beneficiary who shall apply such <br />awards, damages and proceeds t.o the sum secured by the T1. :ee, <br />with the f~xceSSr if any, paid t.o the Tru.stor~ <br /> <br />8. Remedies Cu.'llulac.lve. !Ill wmedies provided in this <br />Trust Deed are distinct and cumulative to any other riqht or <br />remedy under chis Trust Deed or afforded by law or equity, and <br />may be exercised concurrently f independen-tly or successively.. <br /> <br />9. Accelerat:l.on; remedies; sale. [Jpon default by Trustor <br />in the payment of any indebtedness-5ecured hereby for the per- <br />forr~ance of any agreement hereunder, 8eneficiary may declare all <br />sums secured hereby immediately due dnd payable by delivering to <br />Trustee a written Declaration of Default.
