<br /> <br />83...;;;.{j06208 <br /> <br />ADDENDUM TO AGREEMENT <br /> <br />m <br /> <br />WHEREAS, an Agreement for Sale and Purchase of Real <br />Estate was entered into on the 8 day of June 1979, by and <br />between WILLIAM SCHUPPAN and ORMAH SCHUPPAN, husband and <br />wife, as Sellers, and HARRY J. ROMANS and ELLEN C. ROMANS, <br />husband and wife, as joint tenants, as Buyers, and <br />WHEREAS, the said Harry J. Romans and Ellen C. Romans <br />have assigned their interest in this Agreement to Howard <br />Kleier and Donna Kleier, husband and wife, with the consent <br />of the Sellers, and <br />WHEREAS, Sellers' consent was given with the under- <br />standing that certain conditions of the original Agreement <br />referred to herein were to be changed. <br />NOW, THEREFORE, it is agreed by and between the parties <br />hereto that this Addendum shall be, and become, a part of <br />the Agreement for Sale and Purchase of Real Estate dated <br />June 8, 1979, above referred to and held in escrow by the <br />Bank of Doniphan, Nebraska. The parties agree to amendments <br />and addendums to said Agreement as follows: <br />1. The interest rate referred to in subparagraph B <br />of paragraph 2 shall be adjusted upward to the sum of ten <br />percent (10%) per annum against the remaining balance, and <br />it is agreed that the present balance is Twenty Nine Thousand <br />Two Hundred Twelve Dollars and Seventy Cents ($29,212.70) <br />as of November 8, 1983, and by the terms of this Addendum <br />the first payment shall be due on December 1, 1983, and by <br />this Addendum the amount of said payments shall be Three <br />Hundred Dollars ($300) per month for a period of five (5) <br />years, effective December 1, 1983, and ending November 1, <br />1988. It is agreed that at that time a final balloon payment <br />of $24,832.78 shall be due and payable to the original Sellers <br />herein. <br /> <br /> <br />will <br />five <br /> <br />2. It is agreed by and between the parties hereto that <br />any conflict between the terms of the original Agreement <br />for Sale dated June 8, 1979, and this Addendum, dated November <br />17, 1983, shall be controlled by this Addendum. <br />3. It is further agreed that, by the terms of the original <br />Agreement, a late payment drew interest at eleven percent <br />(11%), and by the terms of this Agreement, it is agreed that <br />any late payments shall draw interest at the rate of fifteen <br />percent (15%) per annum. <br />4. It is agreed by and between the parties <br />be no prepayment of principal allowed for a <br />(5) years from date hereof. <br />5. A~l other terms and conditions of the original Agree- <br />ment, including the escrow agreement, shall be in full force <br />a.ud effect, and both Buyers and Sellers shall be bound by <br />its terms. <br /> <br />tha t there <br />period of <br />
