Gearhart and Nancy Kay Gearhart, being first <br />duly and separately sworn each for himself or herself, deposes <br />and says: <br /> <br />That they are the identical parties who have made, executed <br />and delivered that certain deed to the Secretary of Housing and <br />Urban Development of Washington, D.C., dated the i~~ day <br />of Au '4 <;T , 1983, conveying the following described property, <br />to-wit. <br /> <br />Lot Five (5), Piper's Glen Subdivision, being a <br />Subdivision of Lots Eight (8) and Nine (9), Warren <br />Subdivision, in the City of Grand Island, Hall <br />County, Nebraska. <br /> <br />That the aforesaid deed was an absolute conveyance of the <br />title to said premises to the grantee named therein in effect <br />as well as in form, and was not and is not now intended as a <br />mortgage, trust conveyance, or security of any kind, and that <br />possession of said premises has been surrendered to the said <br />grantee; that the consideration in the aforesaid deed was and <br />is payment to deponent of the sum of $1.00 by grantee named <br />therein, receipt for which is hereby acknowledged, together <br />with the full cancellation of all debts, obligations, costs <br />and charges heretofore existing under and by virute of the <br />terms of certain mortgage before described, executed by Ray- <br />mond L. Gearhart and Nancy Kay Gearhart, as mortgagee, dated <br />the 25th day of February, 1981, and recorded at Book 81, <br />Page 897, of the records of Hall County, State of Nebraska, <br />and the cancellation of record by said grantee of said mortgage <br />and the delivery of this affiant of the note or other evidence <br />of debt secured by said mortgage duly cancelled, receipt of <br />which said cancelled note is hereby acknowledged. <br /> <br />That the aforesaid deed and conveyance was made by this <br />deponent as the result of their request that the grantee accepts <br />such deed and was their request that the grantee accepts such <br />deed and was their free and voluntary act; that at the time <br />of making said deed these deponents feel and still feel that <br />the mortgage indebtedness above mentioned represented a fair <br />value of the property so deeded; that said deed was not given as <br /> <br />Sclutm, FOIlD, MOONEY &: FREDERICK <br /> <br />~TZ9_'K1'. <\~ 'l,.,4W <br /> <br />u <br /> <br />L <br /> <br />..J <br /> <br />L <br />
