<br />83-ft05428 <br /> <br />r <br /> <br />FHA ADDENDUI1 <br /> <br />As long as this mortgage is held by the Nebraska Mort- <br />gage Finance Fund (or its legal successor, the Nebraska <br />Investment Finance Authority), the Lender may declare all <br />sums secured by 1:his mortgage to be immediately due and <br />payable if: <br /> <br />(al all or part of the property is sold or other- <br />wise transferred (other than by devise, descent or <br />operation of law) by Borrower to a purchaser or other <br />transferee: <br /> <br />(i) who cannot reasonably be expected to <br />occupy the property as a principal residence within <br />a reasonable time after the sale or transfer, all <br />as provided in Section 103A(d) and (j)(2) of the <br />Internal Re~enue Code; or <br /> <br />(il) who has had a present ownership interest <br />in a p~incipal ~esidence during any part of the <br />three-yea~ period ending on the date of the sale or <br />transfer, all as provided in Section l03(A)(e) and <br />; j ) (2) of the Inte~-nal Revenue Code (except that <br />the lang'1.1age '1:;'00 percentlf 3hall be sut>sti tuted for <br />H90 pe~:cent ,:;f :TIore" wher:-e 'the latter appears in <br />SeC~iQ!l l83A(e)(1); or <br /> <br />(lii) ~t a~ acq~isition C~5t which is greater <br />than 118 per~ent of the average area pu~chase price <br />(greater than 120 percent for targeted area resi- <br />dences), all as provided in Section l03A(f) and <br />(J)(2) of the Internal Revenue Code; Or <br /> <br />(iv) who has an income 1n excess of that <br />established by the Nebraska Mortgage Finance Fund <br />(or its legal successor, the Nebraska Investment <br />Finance Authority) under its applicable regulations <br />or program guideli:les in effect on the date of the <br />sale or transfer; or <br /> <br />(b) Borrower fails to occupy the property <br />described in the ~ortgage without Lender's prior written <br />consent; or <br /> <br />(c) Borrower omits or misrepresents a material <br />fact in an applica~lon for this mortgage. <br /> <br />References aloe to the Internal Revenue Code 1n effect <br />the date of execution of the mortgage, and are deeme~ to <br />include the implementing regulations.
