<br />farm owner, party of the first part, KENNETHW. SHULTZ and
<br />NANCY L. SHULTZ, husband and wife, as joint tenants with
<br />right of survivorship, of Hall County, Nebraska, tenant,
<br />whose address is Doniphan, Nebraska, 68832, party of the
<br />second part, even though more than one.

<br />WITNESSETH: That the first party has leased to the
<br />second party the following described land, to-wit:
<br />
<br />Southwest Quarter (SW~) of Section Thirteen
<br />(13), Township Nine (9) North, Range Nine (9),
<br />West of the 6th P.M., Hall County, Nebraska.
<br />
<br />beginning March 1, 1984, and ending February 28, 1992. And
<br />the second party, in consideration of the leasing of the
<br />premises as above set forth, covenants and agrees with the
<br />first party to pay as rent for same forty percent (40%) of
<br />all crops grown upon the premises with first party to pay
<br />forty percent (40%) of cost of &CC~, fertilizer, chemicals,

<br />Second party shall have the use of the corn stalks,
<br />crop residues, and all buildings and other improvements
<br />located upon the real estate without any additional charge.
<br />
<br />Any major repairs on irrigation power units and pumps
<br />aRd_~}RG ~d ~uipmcnt shall be paid by first party.

<br />OPERATING COVENANTS
<br />
<br />1. The second party will comply with all good farming
<br />practices and will not permit the growing of noxious weeds
<br />on the land and fence rows. If any part of the cultivated
<br />land is set aside under any government program, second party
<br />shall have the obligation to plant and grow a legume cover
<br />crop approved by the A.S.C. and by first party.
<br />
<br />2. The second party will maintain and repair all
<br />fences at his expense. Construction of any new fences shall
<br />require authorization of first party with first party then
<br />furnishing the fencing materials and second party constructing
<br />the fence at no cost to first party for labor or equipment.
<br />
<br />3. Second party to retain use of corn stalks and
<br />other crop residues but shall use care in grazing so as to
<br />leave adequate ground cover to protect land against soil
<br />erosion.
<br />
<br />4. Second party agrees to follow recommended procedures
<br />for servicing and maintaining all mechanical equipment
<br />furnished by first party (includes stock wells, irrigation
<br />well.s, pumps, power units, sprinkler systems, fertilizer
<br />injection equipment, as well as grain storage bins and
<br />equipment) and shall stand cost of normal repairs and maintenance
<br />of any and all equipment. Changing of oil and filters on
<br />irrigatio:n power unit.s and. lubrication of irrigation pumps
<br />and gearheaas and gearboses on pivot systems shall be on a
<br />reg.Ularand timely basis and shall be at the expense of the
<br />second. party.
