<br />r <br /> <br />83- 005328 <br /> <br /> <br />ASSIGNMENT OF LEASE <br /> <br />The County of Hall, State of Nebraska, the Lessee in <br /> <br />the certain Lease fro~ Erwin W. Holtz and DSrleneHolt~, <br /> <br />husband and wife, to the County of Ha 11, Sta te of Nebraska. <br /> <br />attached hereto, dated February 6, 1981, for a period of <br /> <br />twenty years, and for valuable consideration, and of the <br /> <br />agreements and covenants hereinafter contained including the <br /> <br />agreements between the City of Grand Is.land and the County <br /> <br />of Hall of the following terms: <br /> <br />1. Title to the Baler, the Baler Transfer Site, the <br />Baler Building, Equipment, and Supplies, will <br />be transferred from the County of Hall to the <br />City of Grand Island. <br /> <br />2. The City of Grand Island will pay to the County <br />of Hall the sum of $83,000, such payment to be <br />made during the County's next fiscal year ending <br />June 30, 1984, <br /> <br />3. The landfill lease which is currently in effect <br />between the County of Hall and the Lessors, Erwin <br />W. Holtz and Darlene Holtz, will be assigned to <br />the City of Grand Island for the full twenty year <br />term. In the event that this original landfill <br />site does not last for the full term or until February <br />1, 2001, the lease costs will be shared by the City <br />of Grand Island and the County of Hall on a 50/50 <br />basis, notwithstanding exercise of the option for <br />additional land. However, if the City of Grand <br />Island exercises the option for this additional <br />land, the County of Hall will not share in the lease <br />costs for that additional land site in the event <br />that additional land site does not last the twenty <br />year period. <br /> <br />4. The City of Grand Island will provide landfill <br />services to all Hall County residents at the same <br />rate charged to the City customers for the remainder <br />of the lease term. <br /> <br />5. The City of Grand Island will provide a compact- <br />ing system, either Baler or Transfer Station; <br /> <br />does hereby assign, transfer, and set over to the City of <br /> <br />Grand Island, State of Nebrsaka, the said Lease, the premises <br /> <br />thereby demised, and all title and interest in and under <br /> <br />the same; and the City of Grand Island, Nebraska, the said assignee, <br /> <br /> <br />u <br /> <br />L <br /> <br />..J <br /> <br />L <br />
