r 83-005288 r ASSIGNMENT THIS ASSIGNMENT is made this 1!"il:! day of ~~ 1983, by and between JOHN A. HARRINGTON and RUTHE. HARRINGTON, as joint tenants with right of survivorship (hereinafter known as Harringtons), and COMMERCIAL SAVINGS COMPANY OF GRAND ISLAND (hereinafter known as Commercial Savings). FOR VALUE RECEIVED, Harringtons do hereby sell, assign, transfer, and set over unto Commercial Savings all of their right, tille, and interest and equity of redemption i~ and under a certain contract dated the 15 day of March 1983, by and between David G. Davis and Evelyn M. Davis, husband and wife, and John A. Harrington and Ruth E. Harrington, which contract was ~ecorded as Document No. 83-001673 in the Office of the Register of Deeds of Hall County, Nebraska, and further which contract conveys to the Harringtons the real estate described as: The West Half of the Southwest Quarter (W\SW!,;) of Section Fourteen (14), Township Eleven (11), North, Range Ten (10), West of the 6th P.M., Hall County, Nebraska. TO HAVE AND TO HOLD the same unto the said Commercial Savings Company, its successors, and assigns absolutely; provided, however, that this assignment is made to secure payment to the Commercial Savings Company of the sum of Seventy Five Thousand Dollars ($75,000) with interest thereon from the date hereof, which amount is this day loaned to the Harringtons by Commercial Savings. If the Harringtons shall well and truly repay the said loan to Commercial Savings with interest thereon according to the provisions in said note, then this Assignment shall be void, otherwise it shall remain in full force and effect and the Assignee may take such steps as are available to it under the law to make the foregoing Assignment absolute and foreclosing Harringtons of any right, title, or interest in and to said contract. Harringtons warrant that said contract is in full force and effect, that it is not in default, and that all payments required to be made thereon have been paid according to its terms.
