<br />I <br /> <br />r <br /> <br />v. <br /> <br />83- 004975 <br /> <br />Escrow Agent <br /> <br />A, Five Points Bank, Grand Island, Nebrask4, is hereby <br />designated as the Escrow Agent under this contract. All fees <br />charged by the Escrow Agent shall be paid equally by Seller and <br />Buyer. <br /> <br />B. Upon payment by the Buyer of the purchase price in' <br />full, with all interest thereon, and upon the payment by the <br />Buyer of all amounts which may be advanced bv Seller as herein- <br />above provided, and upon the performance by the Buyer of all <br />covenants and conditions which, bv the terms of this contract, <br />are to be performed by the Buyer, 'the Escrow Agent shall deliver <br />the Warranty Deed and abstract to the Buyer, or his heirs, <br />assigns, nominees or successors. <br /> <br />C. It is understood and agreed that the Escrow Agent shall <br />be liable as a depository only of the deed and abstract herein- <br />above referred to. No payments shall be paid to the Escrow <br />Agent. It is understood and agreed that the Escrow Agent shall <br />not be called upon to const.rue ilny contract or instruments <br />accompanying this contract and shall be required to act only as <br />specifically set forth herein. In the event of any dispute <br />bet....een the parties hereto, the Escrow Agent shall have the right <br />to hold the dCCld and abstract deposited hereunder until its fees <br />and expenses, including attorney fees if required, have been paid <br />in full; and until a mutual agreement has been reached between <br />the parties or ~~til delivery is legally authorized and ordered <br />by final judgment or decree of a Court of competent jurisdiction. <br /> <br />VI. <br /> <br />Generlll Aqreemcnt of the Parties <br /> <br />A. Notice of Contract. Simultaneously with the execution <br />of this contract~ the parties ~re executing u Notice of Contract <br />of Sale which may be recorded by Buyer at Buyer's expense.
