<br />receipt of which is herehy acknowledged, herehy grants and conveys
<br />unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,

<br />a municipal corporation in Hall County, State of Nebraska, herein
<br />
<br />
<br />called the Grantee, a permanent and perpetual easement to construct,
<br />
<br />operate, maintain, extend, repair, remove, and replace storm water
<br />
<br />
<br />drainage lines, manholes, and other appurtenances upon, over, in, and
<br />
<br />
<br />through part of Lot Two i2), Block ~lne (9). Continental Gardens, An
<br />
<br />Addition to the City of Grand Island, Hall County, Nebraska, mm:'e

<br />particularly described as follows:

<br />Beginning at a point on the West line of Lot 2, B~ock

<br />Such rights of ingress and egress shall include all rights
<br />necessary [or the full and complete use. occupation, and enjoyment
<br />of the easement herein granted, including the right co excavate and
<br />refill ditches and trenches, to remove trees, bushes, hedges, under-
<br />
<br />growth, and other obstruction,; interfering t~ith the location, con-
<br />
<br />struction. inspection, repair, replacement. removal, and maintenance
<br />
<br />
<br />of such storm drainage lines; provided, if such construction or main-
<br />
<br />
<br />tenance requires the removal of fences, poles, hardsurfaced drive-
<br />
<br />
<br />ways, parking lots, grassed lawns, or other obstructions, the Grantee
<br />
<br />or its contractor agrees to restore the surface of the easement area
<br />
<br />alilsopn llS possible to its condition prior to said construction or
<br />
