The Subdivider agrees to grade the lots <br /> <br /> <br />of the subdivision in conjunction with the <br /> <br />so that storm water drains to the public right-of-way. <br /> <br />5. Sidewalks. The Subdivider, if still the owner <br /> <br /> <br />land in the proposed subdivision, or if the Subdivider shall <br /> <br /> <br />have transferred title to the property, then the various <br /> <br />grantees thereof, will install, at their own expense, all <br /> <br /> <br />sidewalks required by the Grand Island City Code when the <br /> <br /> <br />are built upon, and sidewalks shall be regulated and required <br /> <br /> <br />with the building permit for each such lot. <br /> <br /> <br />6. Flood Hazard. All structures shall have the lowest <br /> <br /> <br />floor, including basements, at a minimum of one foot above the <br /> <br /> <br />elevation of the lOO-year flood plain, or floodproofed to such <br /> <br /> <br />elevation, the method of floodproofing to be certified by a pro- <br /> <br /> <br />fessional registered engineer or architect, and approved by the <br /> <br /> <br />building inspection department of the City of Grand Island. <br /> <br /> <br />7. All principal structures in the subdivision shall have <br /> <br /> <br />a front yard setback of at least 20 feet, with a minimum of 20% <br /> <br /> <br />of the setback to be landscaped, such landscaping to be <br /> <br /> <br />completed within one planting season after the lots are built <br /> <br />upon, and to be in compliance with the Grand Island City Code. <br /> <br /> <br />8. Warranty. The undersigned owner, as Subdivider, <br /> <br /> <br />warrants that it is the owner in fee simple of the land describ- <br /> <br /> <br />ed and proposed to be known as ROEPKE SECOND SUBDIVISION, and <br /> <br /> <br />that an abstract of title will be submitted for examination, <br /> <br /> <br />if necessary, upon request of the City of Grand Island. <br /> <br />9. This agreement shall run with the land and shall be <br /> <br /> <br />binding upon and inure to the benefit of the parties hereto, <br /> <br /> <br />their successors, assigns, heirs, devisees, and legatees. Where <br /> <br />the term "Subdivider" is used in this agreement, the subsequent <br /> <br />- 2 - <br />
