<br />WHEREAS, on January 28, 1983, a previous unvalidated conveyance
<br />of a part of Lot Six (6) in Block Twenty-eight (28) in Russel
<br />Wheeler's Addition to the City of Grand Island, Hall County, Nebrask4,
<br />was continued by conveyance from Eldon Earl Masten, a single person,
<br />as Grantor, to Kevin P. Masten and Carlene M. Masten, husband and
<br />wife, as joint tenants with right of survivorship and not as tenants
<br />in cOlllmon, as Grantees, by Survivorship Warranty Deed recorded in
<br />the Office of the Register of Deeds of Hall County, Nebraska, as
<br />Document No. 83-009494, conveying the South Seventy-five and Eighty-
<br />five Hundredths (S75,85) Feet of Lot Six (6) in Block Twenty-eight
<br />(28) ~n Russel Wheeler's Addition to the City of Grand Island, Hall
<br />County, Nebraska; and
<br />
<br />WHEREAS, Lot Six (6) in Block Twenty-eight (28) in Russel
<br />Wheeler's Addition to the City of Grand Island, Hall County, NebraSka,
<br />contained two pre-~xisting dwel11ng"" one of winch was lc;cated upon
<br />that part of the lot conveyed by Eldon Earl Masten, a sinqle per.son,
<br />as Grantor, to Kevin P. Masten and Carlene M. Masten, husband and
<br />wife, as Joint. tenants with dght of survivorship and not as tenants
<br />in COllIIIJ:m, as Grantees, by the Survivorship Warranty Deed described
<br />above. and the division of the lot was the continuation of a prior
<br />severance of the common ownership of the lot; and
<br />
<br />WHEREAS, the conveyance of part of the lot on January 13, 1983,
<br />d~d not conform to the Subdivision Ordinance of the City of Grand
<br />tl>land; and
<br />
<br />
<br />WHEREAS, objection to marketability of title to that pa.rt of
<br />the lot conveyed by Eldon E,;rl Masten, a single person, as Grantor,
<br />to :Kevin P,Masten dnd Carlene /:1, Masten, husband and wife, as joint
<br />tenants wlth r~9ht of $lJrvlvorshlp and not as tenants in comtllOO, as
<br />Grantees, by the Survivorship Warranty Deed deacribed above, haa
<br />been ra,tsed because of the iilubdiv.lsion of the platted lot without
<br />obta.l.ning the pr lQr approval of t.he Mayor and Council of the City
<br />Grand Island; and

<br />W"tiEREAS, Sect~on 76-2,110, R.R.S. 1943, authorizes the Mayor
<br />and Council of the City of Grand Island to approve the conveyance
<br />subdivlding the lot (or the purpose of validating the conveyance:
