Jensen, as evidenced by a pranissory note date June 28, 1983, the <br />terns of which are incorporated herein by this reference, we Jerry P. and <br />MaryM.Jensen "Assignors," hereby assign, transfer and set over to City <br />Nat:i.onal Batlk & Trust Calpany of Hastings, a national banking corporation, <br />"Assignee," all of our right, title and interest in and to a certain land <br />contract entitled Agreement for sale and purchase of Real Estate, bearing the <br />date of April 29, 1980, wherein Assignors are purchasing the real estate <br />locat.edinHall County, Nebraska, legally described as: <br /> <br />A tract of land. CCIl'Prising a part of the Northwest Quarter of <br />the Southwest Quarter <NW>4~) of Section 'tWenty-one (21), in <br />Tamship Eleven (11) North, Range Nine (9) West of. the 6th <br />P.M., rore particularly described as follows: <br /> <br />fran William S. & Gail L. Schuermann <br /> <br />This AssigI'llrent is given as security for the indebtedness mentioned <br />hereinabove and as security for such other sums as nay be advanced in <br />accorda1x:e with -the terms of the aforerrentioned pranissory note and. this <br />Assignment. In the event such indebtedness, future advances, interest and such <br />othE~r sums as may be advanced in accordance with the terms of the aforementioned <br />prani.ssory note and this A."3sigI'llTent are well and truly paid in accordance with <br />the terms therin contained, then this Assignment shall be void, otherwise to <br />remain in full force and effect. <br /> <br />'The undersigned Assignors shall continue to nake all payments to be <br />madE! according to the terns of the land contract which is herein assigned <br />as siecurity as they becare due according to the terms of said land contract. <br />Should, at any time, Assignee advance any payments in respect to anounts owing <br />on said 1and contract in order to protect its security interest therein, be <br />such advances for the payroont of principal, interest or taxes, this Assignrrent <br />shall ~rate as security for the repayment to assignee of all sums so paid <br />with interest fran the date of such payment equivalent to that provided in the <br />aforerrentioned pranissory note. It is expressly understood that nothing herein <br />cont;ained shall be oonstrued as a covenant or agreement on the part of the <br />Assignee to assune or pay any part of purchase price in respect to the real <br />estate described in the land contract or to pay any taxes or encumbrances there- <br />on. <br /> <br />In the event of default by the Assignors in respect to their obligations <br />Oiling to Assignee, Assignor hereby authorize the sellers of the real estate <br />desGribed. in the aforementioned land contract to execute and make delivery of <br />a deed to Assignee, upon notice of such default being given to the sellers <br />therein. <br /> <br />The undersigned Assignors hereby assign to Assignee all rents and inccme <br />arising at any and all times fran the real estate interest herein assigned as <br />ad(iitional security for the indebtedness herein mentioned and hereby authorize <br />'l:heAssignee or its agent, at its option, upon default, to enter into the <br />pc$sessiqn.. of and take charge of said assigned property, to collect and receipt <br />f()r a:i..l rents and incx:>me therefran, and apply the san-e to the payment of interest, <br />princ~pcU, insurance premiums, taxes, assessm:nts, rep.=lirs or improvements <br />~aryto keep. said property in tenable condition, or to other charges or <br />~ts provkied for herein or in the note heretq secured. <br /> <br />-1- <br /> <br />
