<br />
<br />EVELYN K. THOMPSON AND BERNARD L. THOMPSON, HER HUSBAND, AND WILLIAM L.
<br />KREHMKE AND MARY JO KREHMKE, HIS WIFE, GRANTOR, in consideration of TWENTY-ONE
<br />THOUSAND AND NO/100 DOLLARS ($21,000.00) received from GRANTEES, WILLIAM LINGEMAN,
<br />MICHAEL LINGEMAN AND JANE SPICER, conveys to GRANTEES, as joint tenants and not
<br />as tenants in common, the following described real estate (as defined in Neb.
<br />Rev. Stat. 76-201):

<br />The Southerly Half of the Northerly One-Third (S~ of N 1/3) of Lot
<br />One (1) and of the Easterly One-Third (E 1/3) of Lot Two (2) in Block
<br />Forty-two (42) of the Original Town, now City of Grand Island, Nebraska,
<br />being a rectangular piece of ground having an Easterly frontage of
<br />22 Feet on Pine Street, a depth of 88 Feet and bounded on the North
<br />by a line parallel to Fourth Street and distant Twenty-two (22) Feet
<br />southerly therefrom, EXCEPTING the Southerly 6V' of such premi ses
<br />which was previously conveyed to Homer Bowen, which conveyance was
<br />recorded at Book 71, Page 78 of the Records of the Register of Deeds
<br />of Hall County, Nebraska, and subject, however, to a right-of-way
<br />over the Westerly 12 Feet of such tract, the intention being to have
<br />a private driveway of 12 Feet in width over the Westerly 12 Feet of
<br />the Easterly One-Third (E 1/3) of said Lot Two (2), extending from
<br />Fourth Street to the alley in said Block for the free and unobstructed
<br />use and benefit of the lot owners bordering on, or abutting on said
<br />driveway, or owning ground covered by same, with the right to lay
<br />pipes for gas, water, heat and sewer, etc., under the same, but to
<br />place no obstruction on the surface thereof, and an easement for such
<br />purposes is hereby granted over the entire length and breadth of such
<br />driveway to the grantees herein, reserving however for the other owners
<br />or future owners, the same easement over that part of said driveway
<br />hereby conveyed to the grantees herein. In future conveyances, (including
<br />mortgages) of above described property, the word appurtenances shall
<br />be construed to cover a 11 condi ti ons, easements and ob 1 i gati ons as
<br />to said driveway.

<br />GRANTOR covenants (jointly and severally, if more than one) with GRANTEES that
<br />GRANT{)R:
<br />
<br />(1) is lawfully seised of such real estate and that it is free from encumbrances
<br />except for restrictions, conditions and easements of record and the partywal1 agree-
<br />ment filed at Book P of Page 629 of the Records of the Regi ster of Deeds of Ha 11
<br />County, Nebraska;
<br />
<br />(2) has legal power and lawful authority to convey the same;
<br />
<br />(3) warrants and will defend title to the real estate against the lawful
<br />claims of all persons.
