83- 1)(j2629 pay the same and all amounts so paid shall become additional indebtedness due hereundeq and in the case of foreclosure, T1HJSTORS shall pay any reasonable attorneys fees incurred by BENEFICIARY or TRUSTEE in such foreclosure proceeding. Should the BENBFTCIARY hereunder be made a party to any a.ction affecting this Trust Deed or the title to said real estate, the TRtJSTO:f{S agree that all court costs and reasonable attorneys fees paid by the BENEFICIARY shall become additional sums due hereunder; and the TRUSTORS do hereby release and waive all claims to said real estate as a homestead exemption or other exemption now or hereafter provided bv law. It is agreed that in case of default in payment of said principal or interest or a breach of any covenants herein, then the whole principal sum hereby secured thereupon may at the option of the BENEFICTARY become due and payable at once, and bear interest thereon at the rate of ten percent (10%\ per annum from the date declared due, anything in said Note hereinabove described to the contrary notwithstanding, and possession of said real estate will thereupon be delivered to the BENEFICIARY, and on failure to deliver such possession to the ~ENEFICIARY shall be entitled to a receiver for such property, and may be appointed by any court of competent iurisdiction. Should the real estate, which is herehv placed as security for the indebtedness evidenced bv the Note of the TRUSTORS bearing the date of Mav ';;.0 , 1983, be conveyed or placed as security to a party other than the BENEFICIARY, subiect to this Trust Deed or the balance due thereon, the ~ENEFJCIARY mav, at her option, declare a breach hereo~ and declare the whole princi- pal amount then due on said Note immediately due and exercise her rights as aforesaid.
