<br />84 -- 002058 <br />SECOND MORTGAGE <br />THIS MORTGAGE (he ~~nafter referred to as such) <br />entered into this ~ day of March, 1984, by Glenn H. <br />Hoffman and Wendy L. Hoffman, as husband and wife <br />(hereinafter referred to as "Mortgagor"), to Tenenbaum- <br />Hill Associates, Inc., (hereinafter referred to in such <br />capacity as "Mortgagee"). <br />WITNESSETH: <br />ARTICLE 1 <br />DEFINITIONS <br />1.1 Definitions: As used herein, the following terms <br />shall have the following meanings: <br />(a) Building: Any and all buildings, covered <br />garages, utility sheds, workrooms, air conditioning <br />towers, open parking areas and other improvements, and <br />any and all additions, alterations, betterments or <br />appurtenances, thereto, now or at any time hereafter <br />situated, placed or constructed upon the Land {as <br />defined in Paragraph 1.1(q) hereinbelow) or any part <br />thereof. <br />(b) Event of Default: Any happening or <br />occurrence described in Article 4 hereinbelow. <br />(c) Fixtures: All materials, supplies, <br />equipment, apparatus and other items owned <br />Mortgagor now or hereafter attached to, installed bn <br />or used in connection with (temporarily or <br />permanently) the Building or the Land, including but <br />not limited to any and all gartitions, window screens <br />and shades, rugs and other floor coverings, awnings, <br />motors, engines, boilers, furnaces, pipes, plumbing, <br />cleaning, call and sprinkler systems, fire <br />extinguishing apparatus and equipment, water tanks, <br />heating, ventilating, plumbing, incinerating, and air <br />conditioning and air cooling equipment and systems. <br />(d) Governmental Authority: Any.-and a-11 courts, <br />boards, agencies, commissions, offices or authorities <br />of any nature whatsoever for any governmental unit <br />(federal, state, county, district, municipal, city or <br />otherwise) whether now or hereafter in existence. <br />(e) Mortgagor: The above defined Mortgagor and <br />any and all subsequent owners of the Mortgaged <br />Property (as defined in Paragraph 1.1 (g) hereinbelow). <br />(f) Indebtedness: The principal of, interest <br />on, and all other amounts, payments and premiums due <br />under or secured by the Security Documents (as defined <br />in Paragraph 1.1 (j) hereinbelow). <br />(g) Land: The real estate or interest described <br />in Exhibit "A" attached hereto and incorporated <br />herein, all Buildings and Fixtures and all rights, <br />titles and interests appurtenant thereto. <br />(i) Mortgaged _-__ Property: The Land, <br />Huildings, Fixtures, (as defined in Paragraph <br />1.1) together with: <br />
