The Subdivider agrees to grade the lots <br />of the subdivision in conjunction with the structures thereon <br />so that storm water drains to the public right-of-way or to Brach's <br />Lake. <br />5. Sidewalks. The Subdivider, if still the owner of the' <br />land in the proposed subdivision, or if the Subdivider shall <br />have transferred title to the property, then the various grantees <br />thereof, will install, at their own expense, all public sdawa2ks- <br />required by the Grand Island City Code when the lots are built <br />upon, and sidewalks shall be regulated and rqquired with.ihe <br />building permit for each such iot. <br />6. Flood Plain. Lot 2 of the Subdivision is located.wthn: <br />the flood plain. If residential structures are constructed in.: <br />the flood hazard area, such structures shall have the lowest <br />floor, including basements, at a minimum of one foot above the <br />elevation of the 100-year flood plain, or floadproofed to such <br />elevation, the method of flaodproofing shall be certified by <br />a professional registered engineer or architect and approved, <br />by the building department of the City of Grand Island. <br />i. This agreement shall run with the land and shall be <br />binding upon and inure to *_he bc-.rrefit of the garties hereto,. <br />their successors, assigns, heirs, devisees, and legatees.
