Whitaker, <br />and depose and state as follows: <br />1. That they are the owners of the following-described <br />real estate: <br />Lot Five (5) in Windolph Subdivision, an <br />:'addition to the City of Grand Island, Hall <br />County, Nebraska. <br />z. That an August 20, 1982, they entered into a certain <br />Lease Agreement and certain Option to sell real estate with <br />Lester D. P.umery and Virginia Rumery. <br />3. That they declare on February 1, 1984, a breach of <br />the Lease Agreement for the `allowing reasons: <br />~.. Paragraph ~;ta) was breached for the reason <br />that the rental uaymer,ts were riot z>aid can the `first of each <br />and every month. <br />b. Paragraph 8 cons breached in that the tenant did <br />not make the delinquency l.ayments. <br />c. Paragraphs l4 and i5 were breached .in that the <br />tenants caused a lien tc be placedd upon the premises by <br />Hrvdsky's Re ac;~,~ Mix. <br />4. That pursuant to ParagrapY, 24 of the Lease Agreement <br />and Paragraph 4 of. the Real Estate option, they have declared a <br />breach cf the Lease Agreement anti Real Estate Option and subse- <br />quently rendered each such document r.u11 and void.
