.~._,~ <br />g~ --- 001487 <br />lots designated by numbers and easements by dimensioriS, and <br />propose to cause the plat of such subdivision-when finally <br />approved by the Regional Planning Commission and>Ehe City Council <br />to be acknowledged by such owners, certified-as to. accuracy <br />of survey by a registered land suzveyor, and to Contain a dedi- <br />cation of the easements to the use and benefit of public utilities. <br />In consideration of the acceptance of the plat of said-PARK <br />GARDENS SECOND SUBDIVISION, the Subdividers hereby consent <br />and agree with the City of Grand Island, Nebraska, that they: <br />will install or provide at their expense the following improve <br />ments: <br />I. Residential ~evelaoment. The proposed subdivision <br />constitutes a planned unit development, pursuant to Section <br />36-27 of the Grand Island City Code. For that reason, the <br />Subdividers agree that the continuing requirements of Section <br />36-27 of the Grand Island City Code pertaining to residential <br />develnpment under the planned unit devlopment will be complied <br />with by the Subdividers. <br />2. Streets. The Subdividers waive the right to abject <br />to any caving nr repaving districts of Stolley Park Circle <br />ar Stolley Park Road where they abut the subdivision. <br />3. water. Public water service is available to the <br />subdivision and the Subdividers agree to connect each unit <br />in the subdivision with a separate line to the public water <br />service before applying for an occupancy permit. <br />d. Sanitary Sewer. Public sanitary sewer service is <br />available to the subdivision, and the Subdividers agree to <br />connect each unit in the subdivision with a separate line to <br />the public sanitary sewer system before apglying fnr an occu- <br />pancy permit. <br />5. Drainage. The Subdividers agree to grade the lots <br />of the subdivision in cnnjunctinn with they structures thereon <br />so that storm water drains to the public right-of-way. <br />2 _ <br />
