<br />SPECIAL WARRANTY DEED
<br />KNOW ALL MEN BY THESE PRESENTS: THAT I, WESTERN HEIGHTS DEVELOPMENT
<br />CO., of the county of Hall, State of Nebraska, for and in consideration
<br />of the sum of One and No/100 Dollar ($1.00), and other valuable
<br />consideration receipt of which is hereby acknowledged, do hereby sell
<br />and convey unto FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF LINCOLN,
<br />a United States Corporation, its successors and assigns, the following
<br />described premises, to-wit:
<br />Lot Three (3), Block Thirteen (13), in Lambert's
<br />Addition to the City of Grand Island, Hall County,
<br />Nebraska.
<br />together with all appurtenances thereunto belonging, free and clear of
<br />all encumbrances except a first mortgage in favor of First Federal
<br />Savings and Loan Association of Lincoln, Lincoln, Nebraska,, in the
<br />principal sum of Thirty-six Thousand and No/100 Dollars ($36,000.00),
<br />dated November 14, 1980 and filed for record November 14, 1980, and
<br />re-recorded December 2, 1980, in Document No. 80-006528 and Document
<br />No. 80-06999, respectively, of the Mortgage Records of Hall County,
<br />Nebraska, and easements and restrictions of record, and do covenant to
<br />warrant and defend the said premises against any act of said grantors
<br />or any other person claiming through or under it. The grantors further
<br />covenant that this conveyance is and does constitute an absolute:
<br />conveyance of title to the premises to the grantee herein in effect as
<br />well as form, and is not intended as a mortgage, trust conveyance, or:
<br />as security of any kind and that possession of the premises is delivered
<br />concurrently herewith. And the said grantors hereby relinquish all
<br />right, title, interest and all equity of redemption in and to the
<br />above described premises.
