~I $4 _.._ 4-U0875 f ~ ASSIGNMENT t 'r No assignment or transfer of this contract by the Buyer shall be binding on the Seller unless an assignment is endorsed upon this contract and the name and address of the assignee is furnished by the Buyer to the Seller and the assignee delivers to the Seller a written assumption of this contract and agrees to its terms. vII COVENANTS OF THE SELLER Upon payment by Buyer of the purchase price in full, with all interest thereon, and the performance by Buyer of all covenants and conditions which, by the terms of this contract, are to be performed by Buyer, Seller agrees and covenants to convey the Real Estate to Buyer by warranty deed free of encumbrance, subject, however, to all. other conditions, easements, restrictions and limitations of record; to the rights of persons in possession; to the lien of all unpaid taxes and assessments for public improvements; and to any other encumbrances which, by the terms of this agreement, are to be paid by Buyer. Buyer and Seller agree that the warranty deed-shall be held by the Escrow Agent on the attached Escrow Agreement until the completion of the terms of this contract. Buyer, based on their inspection; accept the improvements on the premises in "as is" condition including any termites and dry-rot. VIII GENERAL AGREEMENT OF PARTIES Buyer and Seller respectively bind their heirs, successors and assigns to the faithful performance of the terms of this agreement.
