r~,~„~ <br />84 --~ ~~~,0586 <br />erection ~ Provisions. <br />All policies of physical damage insurance shall contain <br />waivers of "subrogation and waivers of any defense based on <br />co-insurance or of invalidity arising from any acts of the <br />insured and shall provide that such policies may not be <br />cancelled or substantially modified without at least ten <br />(10) days' prior written notice to all of the insureds, <br />including mortgagees. <br />Section 3. Insurance by Suite Owners. <br />Suite owners shall not be prohibited from carrying <br />other insurance for their own benefit provided that all such <br />policies shall contain waivers of subrogation, provided, <br />further, that no suite owner shall have the right to insure <br />any of the common elements individually. <br />Insurance coverage on furnishings and other items of <br />personal or other property belonging to an owner and public <br />li„bility coverage within each suite or garage shall be the <br />sole and direct responsibility of the suite owner thereof, <br />and the Doard of Administrators and the Association shall <br />have no responsibility therefor. <br />ARTICLE VII. MAINTENANCE AND ALTERATIONS. <br />Section 1. Maintenance. <br />The suite owner shall have the obligation to maintain <br />and keep in good repair the interior surfaces of walls, <br />ceilings, and floors (including carpeting, tile, wallpaper, <br />paint or other covering) as well as all fixtures, utilities. <br />wiring, plumbing and appliances, located within such owner's <br />suite. An owner shall not be responsible for repair to <br />common elements by casualty, unless such casualty is due to <br />the act or negliyence of the owner, his yuests, invitees or <br />tenants. All common element maintenance, including lawn <br />maintenance and snow removal, repairs and replacements to <br />the general common elements, shall be made by the Associ- <br />ation and be charyed to all the suite owners as a common <br />expense, unless such maintenance, repair or replacement is <br />necessitated by the negliyence, misuse or neglect of a suite <br />owner, in which case, such expense shall be charged to such <br />suite owner. <br />Section 2. Alterations by Suits Owners. <br />No suite owner shall make any structural addition, <br />alteration or improvement in or to his suite, or the limited <br />common elements pertaining thereto, including any exterior <br />painting or exterior alteration or addition (including <br />awnings, grills, etc.) without the prior written consent <br />thereto of the Doard of Administrators. The Board of Ad- <br />ministrators shall have the obligation to answer any written <br />request by a suite owner for approval of a proposed structural <br />addition, alteration or improvement in such owner's suite <br />within thirty (30) days after such request, and failure to <br />do so within the stipulated time shall constitute a consent <br />by the Board of Administrators to the proposed addition. <br />alteration or improvement.
