<br />I <br /> <br />C" <br /> <br />83-Q01889 <br /> <br />REAL ESTATE MORTGAGE <br /> <br />THIS MORTGAGE is entered into between JAN STEEPLE and JUDY <br />ST~EPLE, husband and wife, each in his and her own right and as <br />spouse of the other, as "Mortgagor", and JAMES FOSTER and CAROLYN <br />FOSTER, husband and \'life, hereinafter referred to as "Mortgagee". <br /> <br />Mortgagor is indebted to the Mortgagee in the principal sum <br /> <br />of Nine Thousand Three Hundred Sixty ~9Jlars ($9,360.00) <br />denced by Mortgagor's Note dated the ~ day of A~) <br />providing for payment of principal and interest wi h the <br />of the indebtedness, if not sooner paid, due and payable <br />May 1, 1984. <br /> <br />as evi- <br />, 1983, <br />balance <br />on <br /> <br />To secure payment of the Note and sums advanced by Mortgagee <br />to protect the security of this Mortgage, and the performance of <br />the covenants and agreements of the Mortgagor contained herein, <br />Mortgagor does hereby mortgage and convey to Mortgagee the <br />following-described property located in Hall County, Nebraska: <br /> <br />Lot Five (5) situated in the Southwest Quarter <br />of the Southwest Quarter(SW~SW~) of Section <br />Twelve (12), Township Ten (10) North, Range <br />Nine (9), West of the 6th P.M., in Hall County, <br />Nebraska, containing approximately 37 acres, <br /> <br />together with all buildings, improvements, fixtures, easements <br />and appurtenances thereto and the rents and profits therefrom. <br /> <br />Mortgator further covenants and agrees with Mortgagee as <br />follows: <br /> <br />1. Payment. To pay the indebtedness and the interest <br />thereon as provided in this Mortgage and the Note. <br /> <br />2. Title. Mortgagor's are the owners of the property and <br />have the right and authority to mortgage the property and warrant <br />that the lien created hereby is a valid mortgage on the property. <br /> <br />3. Taxes, Assessments. To pay when due all taxes, special <br />assessments and other charges against the property. <br /> <br />4. Insurance. To keep the improvements now or hereafter <br />located on the real estate described herein insured against <br />damage by fire and other hazards as Mortgagee may require, <br />in amounts and with companies acceptable to the Mortgagee and <br />with loss payable to the Mortgagee. <br /> <br />5. Repair, Maintenance and Use.
