<br />SECOND REAL ESTATE MORTGAGE
<br />
<br />HOWARD L. JOHNSTON and ALMA S. JOHNSTON, husband and wife,
<br />Mortgagors, in consideration of FORTY-TWO THOUSAND FIVE HUNDRED
<br />DOLLARS ($42,500.00) received from Mortgagees, mortgage to
<br />DELAINE A. DUNAGAN and ROSELAN G. DUNAGAN, husband and wife, as
<br />joint tenants and not as tenants in common, Mortgagees, the follow-
<br />ing described real estate (as defined in Section 76-201 of the
<br />Revised Statutes of Nebraska, 1943) in Hall County, Nebraska:
<br />
<br />Lot Fifteen (15), Heritage Acres Subdivision, in the
<br />City of Grand Island, Hall County, Nebraska, as sur-
<br />veyed, platted and recorded.
<br />
<br />This Second Real Estate Mortgage is given to secUre the pay-
<br />ment of the principal sum of Forty-Two Thousand Five Hundred
<br />Dollars ($42,500.00) and interest from April 1, 1983, at 12.5
<br />percent per annum if paid on or before October 1, 1983, or at 13.5
<br />percent per annum if paid after October 1, 1983, and before the
<br />due date, April 1, 1984, the principal and interest being due and
<br />payable on April 1, 1984. This Second Real Estate Mortgage is
<br />given to secure a Promissory Note dated April 1, 1983, from
<br />Mortgagors to Mortgagees, due on payable on April 1, 1984, with
<br />interest as herein provided.

<br />Mortgagors agree to pay all taxes and assessments upon the
<br />real estate and all other taxes, levies and assessments, levied
<br />upon this Mortgage and the Promissory Note which this Mortgage is
<br />given to secure before payment is delinquent. If Mortgagors fail
<br />to pay the taxes and assessments before delinquent as required by
<br />this Second Real Estate Mortgage, Mortgagees may pay the taxes and
<br />assessments or other liens and are given a lien secured by this
<br />Second Real Estate Mortgage for the amounts advanced with interest
<br />at the highest legal rate.

<br />Mortgagors agree to insure the improvements on the real
<br />estate against lOSS by fire or other casualty in an amount not
<br />less than the balance due on the Note for which this Second Real
<br />Estate Mortgage is given as security. The insurance policy is to
<br />be endorsed with a mortgage clause payable to Mortgagees and
<br />Mortgagors, as their interests appear. If Mortgagors fail to
<br />secure the insurance, Mortgagees may secure the insurance and pay
<br />the premiums and are given a lien secured by this Second Real
<br />Estate Mortgage for the amounts advanced with interest at the
<br />highest legal rate.

<br />If Mortgagors fail to pay the principal and interest becoming
<br />due and payable on April 1, 1984, pursuant to the terms of the
<br />Promissory Note for which this Second Real Estate Mortgage is
<br />given as security, when the same becomes due, the Mortgagees may
<br />foreclose this Mortgage for the satisfaction of the amount due.
