The terms and-conditions of -this Substitute Lease..- <br />shall be-the sa:~fe as in the original lease'deseribed in <br />paragraph 5 of Article I of this Substitute Lease Agreement:'- <br />- except as specifically amended as follows: <br />1. The correct-legal description of the-Real <br />Estate is agreed to be that .shown an Exhibit.A-to this <br />Substitute Lease Agreement. <br />2. Eihusen, individual.3y is hereby understood to <br />be-the only lessee and no person; firm or: entity other than. <br />Eihusen, his assigns and personal representatives and.-authorized. <br />sublessees shall have any rights or duties with respect ta: <br />the substitute lease. <br />3, Article V of the original lease, Covenants of <br />Lessee, is hereby deleted in its entirety. <br />4. The following is hereby added to-Article VI <br />of the original lease: <br />"Section 6.3. Notwithstanding any other provisions of <br />this Lease any failure on the part of Eihusen to pay any <br />general Real Estate taxes due for 1982 and all prior years <br />against the Real Estate shall not constitute a default. under <br />this-Lease if those taxes, accrued interest thereon and- <br />advertising exgense is actually paid in full to the Hall <br />County Treasurer prior to May 1, 1984. Real Estate-taxes <br />far 1983 and following years shall be paid Uefare the same <br />became delinquent." <br />- 5. Section 8.lic) of the original lease, is <br />hereby deleted. <br />6. Section 16.1 of the original lease, is hereby <br />deleted in its entirety. <br />?. At each place in Article XXI of the original <br />lease where the word lessee appears- that word lessee is <br />hereby deleted and the ward Eihusen is .substituted-therefore, <br />so that-only Eihusen and no other former lessee shall have. <br />any right, option or duty to purchase the Real Estate. <br />8. In the fourth line on page 1 and in Article XXIII <br />of the original lease, the name and address Mayhew Products <br />Corp., 2809 E. Highway 30, Grand Island, Nebraska, 68801 is <br />hereby deleted and the following substituted therefor: <br />Virgil Eihusen, 7I? Stagecoach Road, Grand Island, Nebraska, <br />6880T. <br />ARTICLE IV <br />BINDIt7G EFFECT <br />This Substituted Lease Agreement is fully binding upon <br />Hall County, Trustee and Eihusen as the time of its execution <br />and sha13 be filed of record immediately upon the final <br />execution thereof. <br />~3,,. <br />
