<br />$~ _rs j1~Q4~~ <br />CONSENfi TO SUBSTITUTE LEASE AGREEMENT <br />For and in consideration of Virgil Eihusen having <br />entered into the Substitute Lease Agreement., which i§ <br />hereinafter described hereby acknowledging that Vi:rgi:l <br />Eihusen did so in £ull reliance. upon-the Consent, CLIC does-- <br />hereby promise and agree as follows: ' <br />ARTICLE I <br />Definitions <br />1. Reai Estate means: The real estate legally- <br />described upon Exhibit "A"; <br />attached hereto and'made a <br />part hereof by this reference.: <br />2. Hall County means: County of Hall., State. of <br />Nebraska. <br />3. Trustee means: First National Bank of-Grand. <br />Island located at 202 West Third <br />Street, Grand Island, Nebraska. <br />4. Eihusen means: Virgil Eihusen, an individual, of <br />717 Stagecoach Road, Grand Island, <br />Nebraska. <br />5. Lease means: The Lease and Agreement between <br />Hall County, as Lessor, and Mayhew <br />Products Co., as Lessee, dated <br />November 15, 1973. <br />6. CLIC means: Commercial Loan Insurance Corporation <br />of MGIC Plaza, Milwaukee, Wisconsin. <br />7. Substitute Lease Agreement means: The Substitute <br />Lease Agreement whereunder Eihusen <br />became Lessee of the Real Estate, a <br />copy of which is marked Exhibit <br />"B", attached hereto and made a <br />part hereof. by this reference. <br />ARTICLE II <br />Consent <br />CLIC does hereby consent to the Substitute Lease Agree- <br />ment. CLIC agrees that its insurance policy No. 05-12039 <br />shall continue in full force and effect with respect to the <br />lease to Eihusen contained in the Substitute Lease Agreement <br />in accordance with the terms and conditions contained therein. <br />ARTICLE III <br />Warranties <br />CLIC hereby warrants that: <br />1. CLIC will make tha thirty (30) consecutive monthly <br />basic .rent lease payments which would otherwise be due from <br />Eihusen for the months of November, 1983, through April, <br />1986, inclusive, to the Trustee in the full amounts called <br />for by Exhibit "C" to this Consent Agreement. <br />2. As of December 31, 1983, CLIC shall have made all <br />payments to Trustee which are required by CLIC's insurance <br />policy No. OS-11039. <br />_1_ <br />
