<br />~4.~ (~t~0483 <br />{13) In the event Mortgagor or any of Mortgagor's <br />conveys his interest in the Mortgaged Property, or any part <br />thereof, to any other party, Mortgagee-may, without notice- <br />ta Mortgagor or Mortgagor's successors, representatives., heirs <br />and assigns deal with any owner of-any part of the Mortgaged-` <br />_ Property with reference to this Mortgage and the Secured- <br />Indebtedness, either by way of forebearance on the part of <br />Mortgagee, or extension. of time of payment of Secured Indebt-- <br />- edness, or release of all or any gait of the Mortgaged Prop.- <br />erty, or any other property securing payment of the Secured <br />indebtedness, without in any way modifying or affecting Mort- <br />gagee's Rights and Liens hereunder or the liability of Mort- <br />gagor or any other party liable for payment of the Secured <br />Indebtedness, in whole or in part. <br />{14) Each and every party who signs this Mortgage; <br />other than Mortgagee, and each and every subsequent owner of <br />the Mortgaged Property, or any part thereof, covenants and <br />agrees that he will perform or cause to be performed, each <br />and every condition, term, provision and covenant of-this <br />Mortgage, except that he shall have no duty to pay-the Indebt- <br />edness evidenced by the Note except in accordance with the <br />terms of the Note, and all renewals and extensions thereof, <br />and the terms of this Mortgage are in accordance with. the <br />terms of the transfer to it. Wherever this Mortgage requires <br />notice to Mortgagor, such notice shall be deemed to have been <br />given on the day it is deposited in the United States mail <br />in an enveloge addressed to Mortgagor at the address stated <br />on the first page hereof. <br />{15) This Mortgage is being executed in numerous <br />counterparts, each and all of which shall be deemed originals, <br />and all counterparts tooether shall constitute one and the <br />same document. <br />(16) This Mortgage shall be binding upon Mortgagor, <br />his successors, representatives, heirs and assigns, and shall <br />inure to the benefit of :Mortgagee, or any other holder of <br />the Secured Indebtedness, its successors, representatives, <br />heirs and assigns. <br />{17) In case any term or provision hereof is incon- <br />sistent with any term or grovisior. contained in the Note or <br />the Net Lease, if any, the term or provisions contained in <br />this Mortgage shall be controlling. <br />IN WITNESS WHEREOF, this M~or,~tgage is executed by Mort- <br />gagor and Mortgagee on this ~_-~`1 day of December, 1993, in <br />multiple counterparts. <br />MORTGAGOR-DEBTOR <br />BL'RKE ENERGI CORPORATION <br />B y ~ ~--~ <br />M.
