() <br /> <br />LICENSE AGREEMENT <br /> <br />THIS AGREEMENT by and between the City of Grand Island, <br /> <br />Nebraska, a municipal corporation in Hall County, Nebraska, here- <br /> <br />inafter referred to as the "City", and ANDREW GUDGEL of Grand <br /> <br />Island, Nebraska, hereinafter r,eferred to as the "Licensee". <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the Licensee is the owner of part of Fractional Block <br /> <br />Twelve (12) in Windolph's Addition, and part of Fractional Lot Four <br /> <br /> <br />(4) in Fractional Block Thirty-nine (39) in Charles Wasmer's <br /> <br /> <br />Addition, all in the City of Grand Island, Nebraska, known as 1315 <br /> <br /> <br />West John Street; and <br /> <br />WHEREAS, the Licensee owns an existing shed which encroaches <br /> <br />four (4) feet into the dedicated easement; and also desires to <br /> <br /> <br />construct a garage building which will encroach three (3) feet into <br /> <br />the same dedicated easeIDent; and <br /> <br />WHEREAS, the City Council has authorized the Licensee to <br /> <br /> <br />use and occupy the public easement adjacent to said 1315 West John <br /> <br />for said buildings, subject to certain conditions. <br /> <br />NOW, THEREFORE, in consideration of the payment of One Dollar <br /> <br /> <br />($1.00) and in further consideration of the mutual covenants <br /> <br />herein contained, the parties agree as follows: <br /> <br />1. The City hereby grants to the Licensee a license to <br /> <br /> <br />use and occupy, subject to the terms of this agreement, the north- <br /> <br /> <br />erly four (4) of an easement beginning at a point 3' 8" east of the <br /> <br /> <br />westerly property line easterly for 10 feet for the location of the <br /> <br /> <br />existing storage shed; and the northerly three (3) feet into <br /> <br /> <br />the dedicated easement beginning at a point two (2) feet west of <br /> <br /> <br />the easterly property line for a distance of thirty-two (32) feet <br /> <br /> <br />for the proposed garage to be constructed, such construction to be <br /> <br />in compliance with plans and specifications approved by the City <br /> <br /> <br />builcling department, and such construction to be inspected and <br /> <br /> <br />apProved by the City's building department. <br /> <br /> <br />2. It is understood and agreed that the Licensee may con- <br /> <br /> <br />struct and maintain the existing storage shed and proposed garage <br /> <br />building in the public right-of-way above defined at his own risk. <br /> <br />The Licensee hereby waives any claim for dam<lges against the City <br /> <br />
