<br />That Jim D. Schmidt and Christine A. Schmidt, husband and wife,
<br />Grantors, in consideration of the release of personal liability in
<br />the sum of $22,064.45 due under the terms of a Note dated May 5, 1976,
<br />and in the sum of $11,419.78 due under the terms of a Note dated June
<br />3, 1981, and other good and valuable consideration, do hereby grant,
<br />bargain, sell and convey unto
<br />
<br />THE EQUITABLE BUILDING AND LOAN ASSOCIATION OF GRAND
<br />ISLAND, NEBRASKA, Grantee,
<br />
<br />the following-described real estate in Hall County, Nebraska, to-wit:

<br />Lots Four (4), and Five (5),
<br />Block Two (2), in Clarkson's
<br />First Addition to AIda, Hall
<br />County, Nebraska.
<br />
<br />Grantors further state that this Deed is an absolute conveyance,
<br />is freely and fairly made, is in consideration of a release of per-
<br />sonal liability as above stated, and is not intended as a mortgage
<br />or given as additional collateral or security,
<br />
<br />It is the expressed intention of the par-
<br />ties hereto, that the rights of the Grantee
<br />under the mortgages recorded as Document Nos.
<br />76-002503 and 81-002872 shall not merge with
<br />the fee title conveyed by this Deed,
<br />
<br />Said Grantee is to have and to hold the above-described pro-
<br />perty, together with all tenements, hereditaments and appurtenances
<br />thereto belonging unto the Grantee and to its successors and assigns
<br />forever, The Grantors also covenant with the Grantee and the Gran-
<br />tee's successors and assigns that the Grantors are lawfully seized
<br />of said premises, and that they have the right and lawful authority
<br />to convey the Same.
