<br />HOLIDAY GARDEN TOWNHOUSES, A Nebraska Partnership, herein called Grantor,

<br />in consideration of

<br />One Dollar ($1.00) ,receipt of which is hereby
<br />
<br />acknowledged, hereby grants and conveys unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />
<br />a municipal corporation in Hall County, Nebraska, herein called Grantee, a
<br />
<br />permanent and perpetual easement and right-of-way to survey, construct,
<br />
<br />inspect, maintain, repair, replace~ extend, remove, and operate thereon,
<br />
<br />public utilities, including but not limited to, electric power lines, watermains,
<br />
<br />sanitary sewers, storm sewers,. gas mains, telephone lines,. pipe lines, mains.,
<br />
<br />cables, surface markers, and other appurtenances connected therewith, in,
<br />
<br />upon, above, along, across, underneath, and through a tract of land located in
<br />
<br />part of the Holiday Garden Second Subdivision, an Addition to the City of
<br />
<br />Grand Island, Hall County, Nebraska, more particularly described as follows:

<br />A 16 foot wide permanent utilities easement in part of Lot 3,
<br />Holiday Garden Subdivision, an Addition to the City of Grand
<br />Island, Hall County, Nebraska; the centerline of which is more
<br />particularly described as follows: Commencing at the Southwest
<br />corner of Lot 2, said Holiday Garden Subdivision; thence
<br />S 00000'00" E for 7.55 feet to the true point of beginning;
<br />thence N 88012'02" W for 173,68 feet of a bend; thence
<br />N 87045' 58" W for 227.85 feet to a tee; thence N 89044' 15" Iv
<br />for 136.28 feet to a point on the Westerly property line of
<br />said Lot 3, said point being N 00017'15" E for 42,20 feet
<br />from the Southwest corner of said Lot 3.

<br />Also, a permanent utilities easement in part of Lot 3, said
<br />Holiday Garden Subdivision, more particularly described as
<br />follows: Beginning at the Southwest corner of Lot 2, said
<br />Holiday Garden Subdivision; thence N 90000'00" E for 14.22
<br />feet along the Southerly line of said Lot 2; thence
<br />S 88012'02" E for 89.50. feet to a point of bend; thence
<br />N 22010'51" E for 3.04 feet to a point on the Southerly
<br />line of said Lot 2; thence N 90000'00" E for 17.29 feet;
<br />thence S 22010'51" \0/ for 20.68 feet to 11 point of bend;
<br />thence N 88012'02" W for 114.75 feet; thence N 00000'00" E
<br />for 15.55 feet to the point of beginning.

<br />Lot 3, said Holiday Garden Subdivision, the centerline of
<br />which is more particularly described as follows: Commencing
<br />at the Southwest corner of said Lot 3; thence N 00017'15" E
<br />for 42,20 feet along the Westerly line of said Lot 3; thence
<br />S 89044'15" E for 136.28 reet to a tee; thence N 00000'29" E
<br />for 8.00 feet to the point of beginning, said point being on
<br />the Northerly edge of the above described utilities easement;
<br />thence N 00000'29" E for 36.6 feet being the end of easement.
