If my spouse and I shall die simultaneously or. <br />under any such circumstances that the-order of our deaths <br />cannot be established by proof, then I direct that my spouse <br />shall be conclusively presumed to have survived me and that <br />alI of the property awned by me and passing under this Will <br />shall be distributed as if my spouse had survived me. <br />12. Having conferred in detail regarding the pro- <br />visions of this, my Last Wi11 and Testament, with Howard E. <br />Tracy of The Legal Professional Corporation of Howard E. <br />Tracy, of Grand Island, Nebraska, I hereby waive all provisions <br />of the laws of Nebraska pertaining to privileged communications <br />between attorney and client, and expressly as to privileged <br />communications between said attorney and me with respect to <br />this, my Last Will and Testament. I expressly authorize <br />said attorney of such law firm to testify as to any communi- <br />cations had with him regarding the provisions of this, my <br />Last Will and Testament, whenever and wherever necessary to <br />properly administer my estate, and request my Personal <br />Representative to confer with said attorney whenever necessary <br />on matters pertaining to the probate and administration of <br />my estate. <br />13. This, my Last Will and Testament, is to be construed <br />under the provisions of the Nebraska Probate Code now in <br />effect. I intend that the words and phrases of this will <br />shall have the same meanings as are expressed in the Nebraska <br />Probate Code now in effect. <br />19.
