<br />($ 50,000.00 ), receipt acknowledged from MORTGAGEE, sell and
<br />convey unto BANK OF WOOD RIVER, MORTGAGEE, of County of Hall, State of
<br />Nebraska, the following described real estate situated in Hall County,
<br />Nebraska:

<br />The Southeast Quarter of the Northeast Quarter (SE~ NE~) and
<br />the Northeast Quarter of the Southeast Quarter (NE~ SE~) of
<br />Section Twenty-Six (26) in Township Ten (10) North, Range Eleven
<br />(11) West of the 6th P.M., Hall County, Nebraska.
<br />
<br />MORTGAGORS intend to convey by this Mortgage an absolute title in
<br />fee simple including all rights of homestead and dower.
<br />
<br />The real estate is subject to a Mortgage to The Federal Land Bank
<br />of Omaha dated April 25, 1978, filed in the Office of the Register of
<br />Deeds of Hall County, Nebraska, on April 26, 1978, recorded as
<br />Document No. 78-002424. This Mortgage to The Federal Land Bank of Omaha
<br />is referred to as the "First Hortgage."
<br />

<br />This Second Real Estate Mortgage is given to secure the payment of
<br />the principal sum of FIFTY ~HC~SAND PN:D KC'!100 - - - - % - - - - - - - -
<br />Dollars ($ 50,000.00 ), with interest at l~ percent per annum,
<br />payable in accordance with the terms of a Promissory Note dated
<br />MARCH 21, 1963 , 1983, executed and delivered by MORTGAGORS to
<br />MORTGAGEE, due and payable on D~EM!lER 10, , 19~.
<br />
<br />I~RTGAGORS agree to pay all maturing installments of principal and
<br />interest of the First Mortgage, and all taxes, levies and assessments levied
<br />upon this Mortgage and the Note which this Mortgage is given to secure before
<br />payment is delinquent. If MORTGAGORS fail to pay the payments due on the
<br />First Mortgage or the taxes and assessments before delinquent, ~IDRTGAGEE
<br />may pay the payments due on the First Mortgage, the taxes and assessments,
<br />and any other liens ~~RTGAGORS permit upon the real estate, and MORTGAGEE
<br />is given a lien secured by this Mortgage for the amounts advanced by
<br />l~RTGAGEE, with interest at the highest legal rate.
<br />
<br />Time is of the essence. If ~~RTGAGORS default in payment of the
<br />Promissory Note when due and payable, or fail to perform any of the terms
<br />of this Mortgage before the indebtedness for which this Mortgage is given
<br />to secure has been paid in full, the HORTGAGEE may, at MORTGAGEE I Selection,
<br />without notice or demand, foreclose this Mortgage for the satisfaction of
<br />the amount due on the Promissory t;ote for which this Mortgage is given as
<br />security and for the amounts paid by MORTGAGEE under the terms of this
<br />Mortgage.
<br />
<br />MORTGAGEE, pending foreclosure of this Mortgage and after decree and
<br />pending stay thereon or appeal and pending sale of the premises mortgaged,
<br />may pay the taxes and maturing interest or maturing installments of princi-
<br />pal on the First Mortgage and these payments made by MORTGAGEE shall be
<br />added to the amount due on the decree and upon confirmation of sale by the
<br />court ordered taken out of the proceeds of sale, or if redeemed during the
<br />stay of foreclosure, appeal or sale, the amounts shall be collected the
<br />same as though they were a part of the decree of foreclosure.
