<br />KNOW-ALL MEN BY THESE PRESENTS: That HEARTLAND AG1tT SUPPLY,
<br />ING., a Nebraska corporatioh, of Hall County., and State of
<br />Nebraska, in consideration of the sum of One Hundred 'F fifty
<br />Thousand Dollars {$150,000.00) in hand paid, does hereby: sell-and
<br />convey unto COMMERCIAL CREDIT BUSINESS LOANS, INC.,- a Delaware
<br />corporation, the following described premises situated in Hall
<br />County, and State of Nebraska, to-wit:
<br />A tract of land comprising a part of the Northeast
<br />Quarter (NEB) of Section Twenty-four (24), Township
<br />Eleven (11) North, Range Ten (10), 6~est of the 6th
<br />P.M., in Hall County, Nebraska, more particularly.
<br />described as follows: Beginning at the center of
<br />said section twenty-four (24); thence northerly
<br />along and ugon the west Line of said northeast
<br />quarter {NE's) a distance of seven hundred fifteen
<br />and eight tenths (715.8} feet, to a point on the
<br />southerly right-of-way line of U.S. Highway No. 30;
<br />thence deflecting right 60.33' and running north-
<br />easterly along and upon said right-of-way line, a
<br />distance of thirty-seven and nine tenths (37.4) feet
<br />to the actual place of beginning; thence continuing
<br />northeasterly along and upon said right-of-way line,
<br />a distance of two hundred eighty-seven & eight
<br />hundredths (287.08) feet; thence deflecting right
<br />90.00' and running southeasterly a distance of two
<br />hundred {200.0) feet; thence deflecting right 90'00'
<br />and running southwesterly a distance of four hundred
<br />{400.0) feet to a point thirty-three (33.0) feet east
<br />of the west line of said northeast quarter (NEB,);
<br />thence northerly parallel to said west line of the
<br />northeast quarter {NE's); a distance of two hundred
<br />twenty-nine and sixty-eight hundredths (229.68) feet
<br />to the actual place of beginning and containing 1.577
<br />acres, more or less, subject to channel easement
<br />situated in the northwest corner of described property.
<br />The intention being to convey hereby an absolute title in fee
<br />simple, including all the rights of homestead and dower.
<br />TO HAVE AND TO HOLD the premises above described, with all
<br />the apgurtenances thereunto belonging, unto the said mortgagee(s)
<br />and to its assigns forever, provided always, and these presents
<br />are upon the express condition that if the said mortgagor, or its
<br />assigns shall pay or cause to be paid to the said mortgagee, or
<br />its assigns the principal sum of One Hundred Fifty Thousand
<br />Dollars ($150,000.00) payable with interest according to the
<br />tenor and effect of the mortgagor's written Promissory Note bear-
<br />ing even date with these presents; and shall pay all taxes and
<br />assessments levied upon said real estate, and all other taxes,
<br />legies, and assessments levied upon this mortgage or the note
<br />which this mortgage is given to secure, before the same becomes
<br />delinquent, and keep the buildings on said premises insured for
<br />value,- loss, if any, payable to the said mortgagee, then these
<br />presents to be void, otherwise to be and remain in full force.
<br />IT IS FURTHER AGREED (1) That if the said mortgagor shall
<br />fail to pay such taxes or procure such insurance, the said
<br />mortgagee may pay such taxes and procure such insurance; and the
<br />sum.sta advanced, with interest at prime rate, shall be repaid by
<br />said mortgagor, and this mortgage shall stand as security for the
<br />same. (2) That a failure to pay any of said money, either prin-
<br />aigal or interest, when the same becomes due, or a failure to
<br />comply.wi-th any of the foregoing agreements, shall cause the
<br />
