<br />SPECIAL G7ARRANTY DEED
<br />1: The City of Grand Island, Nebraska, by .action of its
<br />City Council on November 2I, 1933, enacted Ordinance No. 6960,
<br />which directed the conveyance of the-teal-estate described`beloa-
<br />and-the manner and-terms thereof.
<br />2. Ordinance No. 6960 was published in the-Grand ZsSand
<br />Daily Independent according to lasa, and notice o~-such sale and'..
<br />the terms thereof were published in the .Grand Island Daily'
<br />Independent for three successive weeks; on November 29, December:.'
<br />6, and December 13, 1983, all as required by Section 16-202;..
<br />R.R.R. 1943.
<br />3. No remonstrance a_;ainst such sale U.*as filed„faith t:ie.
<br />City Council of the City of Grand Island, Nebraska., catkin thirty
<br />days of the passage and publication of Ordinance No. 696.0_:
<br />4. Section 5 of Ordinance PIo. 6960 provides that if nb
<br />remonstrance be filed against such conveyance, the Mayor .and.-City
<br />Clerk shall make, execute and deliver to the Grantee a Special.
<br />Warranty Deed for said real estate, and the execution of-such --
<br />Deed is hereby authorized without further action on behalf of
<br />the City Council.
<br />NOLd, THEREFORE, the City of Grand Island, Nebraska, a
<br />municipal corporation in Hall County, Nebraska, as Grantor, in
<br />consideration of One Dollar ($1,00) received from Grantee, does
<br />hereby grant, bargain, sell, convey, and confirm unto
<br />DAVID WILLIAM HARRIS,
<br />a single person, herein called the Grantee, the follo*.Jing desc~~'~ed
<br />real property in Hall County, Nebraska:
<br />The westerly 19 feet of Lot Three (3), and the
<br />easterly 19 feet of Lot Four (4), in Block Thirty-
<br />one (31), Original Town, now City of Grand Island,
<br />Hall County, Nebraska,
<br />hereinafter referred to as the Premises.
<br />To have and to hold the above described premises unto the
<br />Grantee and to Grantee`s heirs, devisees, executors, administrators,
<br />successors, and assigns, forever, so long as the Grantee performs
<br />all of the covenants and obligations contained in uaragraph 6 of
<br />the "Agreement for Purchase of Real Estate" recorded as Document
<br />No. 83-006103 in the office of the Register of Deeds of Hall County,
<br />Nebraska.
<br />This Special Warranty need shall convey to Grantee an estate
<br />in fee simple determinable, and in the event of breach of any of
<br />the provisions of paragraph 6 of the foregoing Agreement for
<br />Purchase of Real Estate, the possibility of reverter shall vest in
<br />the Grantor herein, the City of Grand Island, Nebraska.
<br />Grantor hereby covenants with Grantee and with Grantee's
<br />heirs, devisees, executors, administrators, successors, and assigns,
<br />that Grantor is lawfully seized of said Premises; that they are
<br />free from encumbrance., except for the foregoing conditions, easements,
<br />and restrictions of record; that Grantor has good right and lawful
<br />authority to convey the same., subject to the foregoing conditions;
<br />and that Grantor warrants and will defend the title to said Premises
<br />against the lawful claims of all persons -whomsoever.
