<br />GRANT OF RIGHT OF WAY <br />~' <br />The parties to this agreement are Floyd L. Lamphear and:Gla$ys- <br />Lamphear, husband and wife, referred to herein as Eirst'Partes -- <br />and Dobesh Farms, Inc., a Nebraska corporation, referred to -: <br />herein as Second-Party. <br />First Parties are the owners of the North Half of-the Northeast <br />Quarter (N~NE3q} of Section Thirty-five {35},.Township Eleueri'(11) <br />North, Range Eleven (11) West, Hall County, Nebraska.. <br />Second Party has contracted to purchase the South Half of the <br />Northeast Quarter (S~NE4) of said Section Thirty-five`(35); <br />conditioned upon obtaining an easement or right of way over. <br />and across the west thirty-six (36) feet of the tract owned by <br />First Forties for ingress and egress by Second Party wi h farm <br />equipment from the highway which runs along the north side of <br />their land to the northwest corner of the-land Second Party has <br />contracted to purchase. <br />A quanset building owned by First Parties is presently situzted <br />on the dividing line between the land owned by First Parties and <br />the land Second Party has contracted to purchase. <br />First Parties by this agreement, in consideration of the mutual <br />rights granted by each of the parties hereto, to the other, grant <br />to Second Party its successors and assigns to enable it to con- <br />summate the purchase of the real estate adjoining their real <br />estate to the south full and free right and liberty for it, its <br />tenants, employees and licensees to have perpetual access to this <br />real estate across the westerly thirty-six feet from the public <br />highway with machinery and equipment for farming and enjoyment of <br />said land, and to pass and repass along said westerly portion and <br />Second Party acknowledges First Parties are the owners of the <br />quanset building located in part on their land and in part `_, the <br />land Second Party is purchasing with the full use thereof retained <br />by First Parties for so long as this building remains in its pre- <br />sent location. <br />..! c,.n,.....~,,.. <br />Executed this -#~ day of ~ecem~ie~ 198 <br />riy .~' a ntl...h f <br />~..
