<br />200809521 <br /> <br />ASSIGNMENT OF DEED OF TRUST <br /> <br />THIS ASSIGNMENT OF MORTGAGE (this "Assignment") is made by the FEDERAL <br />DEPOSIT INSURANCE CORPORATION ("FDIC") as receiver for Netbank ("Assignor"), <br />whose address is 550 1 th Street, NW, Washington, DC 20429 to and in favor of LNV <br />Corporation ("Assignee") whose address is 7195 Dallas Parkway, PIano, Texas 75024, pursuant <br />to the terms of that certain Loan Sale Agreement, (the "Purchase Agreement"), effective the 29th <br />day of May, 2008, between Assignor and Assignee. <br /> <br />THIS ASSIGNMENT WITNESSES THAT, in consideration ofTen Dollars ($10.00) and <br />other good and valuable consideration paid by Assignee, Assignor hereby assigns, transfers, sets <br />over and conveys to Assignee and its successors and assigns, without recourse and without <br />representation or warranty, whether express, implied or created by operation of law, except as <br />expressly set forth in the Purchase Agreement, the following: <br /> <br />BC:632685 <br /> <br />1. <br /> <br />that certain Deed of Trust from Efrain Lazarin, a married person and Liobardo <br />Rivera, an unmarried person, dated November 13,2006, and recorded November <br />17, 2006, in Book n/a, at Page n/a, as Instrument No. 0200610295, in the Clerk's <br />Office of the County of Hall, State of Nebraska, (the "Deed of Trust"), which <br />Deed of Trust secures that certain Promissory Note dated November 13, 2006, in <br />the original principal amount of $76,900.00, executed by Efrain Lazarin and <br />Liobardo Rivera and payable to the order of Meritage Mortgage Corporation, as <br />modified or amended (the "Note"); <br /> <br />2. <br /> <br />Assigned to Everhome Mortgage Company by an assignment recorded on August <br />8, 2007, in Book n/a, at Page n/a, as Instrument No. 0200706769, in the Clerk's <br />Office of the County of Hall, State of Nebraska. <br /> <br />3. <br /> <br />such other documents, agreements, instruments and other collateral that evidence, <br />secure or otherwise relate to Assignor's right, title or interest in and to the <br />Mortgage and/or the Note and/or the loan evidenced by the Note, including <br />without limitation the title insurance policies and hazard insurance policies <br />relating thereto that are in effect. <br /> <br />2 <br />
