That the remaining principal balance of $148,925.00 <br />shall be payable in semi-annual payments as follows: <br /> <br />$2,015.00 payable on the first day of January, 1984, <br />and $2,015.00 on the first day of each July and <br />January thereafter until the first day of January, <br />1998, when the entire unpaid balance of principal <br />and irterest shall become due and payable, with <br />interest on the unpaid balance thereof at the rate <br />of lli% payable on the first day of January, 1984, <br />and semi-annually thereafter and, in addition thereto, <br />the last sentence in Paragraph First of the mortgage .~ <br />referred to above shall be and is hereby amended to YDi9, <br />read, "It is agreed that the in~rre~h:provided for =.'~ n . ~ ;.CJ~/?:t <br />Subsection (g), above, shall be~'1:" annum or th7"-" Y'"-- ' " ' <br />highest lawful rate permitted by contract under <br />applicable law, whichever is lesser." <br /> <br /> <br />3. All semi-annual installments of principal and interest <br />as provided for in said promissory note and mortgage and this <br />modification thereof will be paid on the due dates by the Buyer. <br /> <br />4. The terms of the promissory note and mortgage referred <br />to above are in all other manner ratified and approved by the <br />parties hereto, subject only to the modifications heretofore set <br />forth. <br /> <br />5. Loyd A. Luehr and Judith A. Luehr, husband and wife, as <br />Buyer, jointly and severally, covenant, promise and agree as follows: <br /> <br />A. To pay said promissory note and installments, <br />principal and interest, at the times and in the <br />manner in all respects as therein provided and <br />provided in this modification, renewal and <br />assemption agreement; <br /> <br />B. To perform each, every and all of the obligations <br />provided in said mortgage and note to be performed <br />by the Seller at the time and in the manner and in <br />all respects as therein provided, except as modified <br />in this agreement; <br /> <br />C. To be bound by each, every and all of the terms and <br />provisions contained in said promissory note and <br />mortgage securing the same as modified by this agree- <br />ment, all as though said promissory note, mortgage and <br />each of said instrunents have been originally made, <br />executed and delivered by the Buyer. <br /> <br />6. Upon the completion of the sale referred to above and the <br />payment of the payments set forth at Item 1, above, Mortgagee shall <br />proceed to release that property described in the recitations above <br />consisting of 5.18 acres, more or less, in the NwtSEt of Section 9, <br />Township 9 North, Range 11 West of the 6th p.r!. in Hall County, <br />Nebraska, together with Lots 5 and 6 located in the NEt of said <br />Section 9, Township 9 North, Range 11 West of the 6th P.M. in <br />Hall County, Nebraska. <br /> <br />-3- <br />
