THESENVITZ and <br /> <br />GLORIA J. THESENVITZ, husband and wife, hereinafter designated <br /> <br />as "Seller"; LOYD A. LUEHR and JUDITH A. LUEHR, husband and wife, <br /> <br />hereinafter designated as "Buyer"; and THE EQUITABLE LIFE <br /> <br />ASSURANCE SOCIETY OF THE UNITED STATES, hereinafter designated as <br /> <br />"Mortgagee" ; <br /> <br />WIT N E SSE T H: <br /> <br />WHEREAS, the Seller is obligated and liable to the Mortgagee <br /> <br />for the payment of a certain promissory note in the principal <br /> <br />amount of $161,000.00 dated December 1, 1979, and bearing interest <br /> <br />at the rate of ll~% per annum, the said promissory note made and <br /> <br />executed by the Seller and secured by a mortgage dated December 1, <br /> <br />1979, the same being recorded on January 15, 1980, as Document No. <br /> <br />80-000200 of the Records of the Register of Deeds Office of Hall <br /> <br />County, Nebraska, and Mortgagee presently being the owner and holder <br /> <br />of said promissory note and :;lOrtgage and the said P.1ortgage on the <br /> <br />date hereof being a first lien against the following described real <br /> <br />estate located in Hall County, Nebraska, to-wit: <br /> <br />The South Half of the Southeast Quarter (~SEt), the <br />North Half of the Southeast Quarter (NtSEt), and Lots <br />Five (5) and Six (6) in the Northeast Quarter (NEt), all <br />in Section Nine (9), Township Nine (9), Range Eleven <br />(11) West of the 6th P.M., in Hall County, Nebraska. <br /> <br />WHEREAS, the Seller has sold and conveyed the above-described <br /> <br />premises to the Buyer, and both the Seller and the Buyer have re- <br /> <br />quested that the Mortgagee release that property described as <br /> <br />follows: <br /> <br />A parcel of land located in the Northwest Quarter of <br />the Southeast Quarter (NwtSEt> , Section Nine (9), Town- <br />ship Nine (9) North, Range Eleven (11) West of the 6th <br />P.M., Hall County, Nebraska, described as follows: <br />
