i <br />~~ --..c-uoo~o <br />r <br />ASSUMPTION AGREEMENT <br />THIS ASSUMPTION AGREEMENT is made on this 30th day of <br />December; 198'3, by and between BRADX AND ASSOCIATES, SNC., <br />hereinafter referred to as the "9orrower"; THE OVERLAND NATIONAL <br />BANK OF GRAND ISLAND, hereinafter referred to as "Payee"; and- <br />N. RZGHARD HADENFELDT and JANICE E. HADENFEI,DT, husband and wife; <br />KEVIN L. PRIOR and :LAMS M. PRIOR, husband- and wife; and H-P <br />ENTERPRISES A Nebraska partnership; hereinafter referred to as <br />"Assuming Parties". <br />W I T N E S S E T H: <br />t+IRERF,AS, Borrower is desirous of selling certain- real <br />property legally described as: <br />The Southerly Forty-Four Feet {S 44') of <br />Lot One {1), Alock Sixty-Two f62?, Original <br />Town, Now City of Grand Island, Hall County, <br />Nebraska; <br />to the Assuming Parties conditioned upon assumption of certain <br />indebtedness created by the original purchase of such real <br />property; <br />WHEREAS, Assuming Parties are desirous of assuming all <br />obligations in respect to a certain Mortgage Note bearing <br />date of May 1, 1981, in the original principal amount of For.v <br />Thousand and No{100 Dollars {540,000.00) as modified and extended <br />pursuant to a Modification and Extension Agreement dated May 1, <br />1983, and further assuming all obligations in respect to that <br />certain real estate Mortgage dated May 1, 1981, upon the <br />above-described real estate given as security for said Mortgage <br />Note.. <br />L~7HEREAS, Payee consents to such assumption and agrees not to <br />accelerate the indebtedness evidenced by such Mortgage dote and <br />Modification and Extension Agreement; <br />SvFIEREAS, Borrower acknowledges that this Assumption <br />Agreement shall in no way affect its continuing liability in <br />respect to said Mortgage Note and Modification and Extension <br />Agreement, <br />NOW, THERRFORE, in consideration of the mutual covenants <br />herein contained, it is agreed: <br />1- Payee floes hereby consent to the assumption of said <br />Mortgage Note and Modification and Extension Agreement by the <br />-1- <br /> <br />- ~ J <br /> <br /> <br />
