Martgagor represents and warrants that: <br />(a) Mortgagor's leasehold interest is not encumbered; <br />(b) Mortgagor has performed all obligations required by said Lease <br />as of the date of this instrument and said lease is currently in full <br />force and effect in accordance with its terms. <br />. 9. By accepting payment of any sums secured hereby after its due <br />date, Mortgagee does not waive its right either to require prompt payment <br />when due of all other sums sa secured or to declare default far failure <br />so to pay, and any forbearance by Mortgagee in exercising any right or <br />remedy it may have shall not be a waiver thereof. <br />10. All remedies provided herein are distinct and cumulative to <br />any other right afforded by law or equity, and may be exercised concurrently, <br />independently or successively. <br />1].
