<br />MORTGAGE Second Mortgage <br />for <br />- -- 83-- Section 235 Cases <br />OC~Ob~,~ <br />With Addendum, for Repayment of Section 235 Assistance <br />THIS MORTGAGE, made and executed this 11th day of February , A.D. <br />19 83 , by and between R. Andrew Hanson and Vicki Lynn Hanson, Husband and Wife <br />of the County of Hall , and State o€ Nebraska, 'party of the first part, <br />hereinafter called the Mortgagor and the Secretary of the Department of Housing and <br />Urban Development <br />party of the second part, hereinafter called the Mortgagee. <br />WITNESSETH: That the said Mortgagor, is justly indebted to the Mortgagee in the <br />principal sum of One Hundred Twenty Four Thousand Two Hundred and No/100ths----- Dollars <br />($ 124,200.00 ) which principal sum will not exceed an amount computed under the terms <br />of the Note executed by said Mortgagor on February 11, 1983 , with interest, in accordance <br />with said Note. That as security for said Note the Mortgagor does by these presents Grant, <br />Bargain, Sell, Convey and Confirm unto the Mortgagee, its successors and assigns the followinc <br />described real estate situated in the County of Hall State of Nebraska, to wit: <br />The South Ten (10) feet of Lot Six (6), all of Lot Seven (7), and the <br />North r^ive (5) feet of Lot Eight (8) Wolfe's Subdivision in the city <br />of Grand Island, Hall County, Nebraska <br />TO HAVE AND TO HOLD the premises above described, with all the appurtenances <br />thereunto belonging and including all heating, plumbing and 13ghting fixtures and equip- <br />ment now or hereafter attached to or used in connection with said real estate unto the <br />Mortgagee, and to its successors and assigns, forever. The Mortgagor represents to, and <br />covenants with, the Mortgagee, that the Mortgagor has good right to sell and convey said <br />praxises; that they are free from encumbrance, except for an FAA first mortgage; and that <br />the Mortgagor will warrant and defend the same against the lawful claims of all persons <br />whomsoever; and the said Mortgagor hereby relinquishes all rights of homestead, and all <br />marital rights, either in law or in equity, and a12 other contingent interests of the <br />Mortgagor in attd to the above-described premises. the intention being to convey hereby an <br />absolute title, in fee simple, including all rights of homestead, and other rights and <br />interests as aforesaid. <br />PROVIDED ALWAYS, and these presents are executed and delivere3 upon the following <br />conditions, to wit: <br />The Mortgagor agrees to pay to the Mortgagee, on order, the principal sum of <br />One Hundred Twenty Four Thousand Two Hundred and No/100ths------------------ Dollars <br />($ ), with interest as provided in the Note dated February 11, ].983 and <br />124,2D0.00 <br />executed by Mortgagor. <br />The Mortgagor in order more fully to protect the security of this Mortgage, agrees <br />1. That he will pay the indebtedness, as hereinbefore provided. Privilege is <br />reserved to gay the debt in whole, or in an amount equal to one or more monthly gayments <br />on the principal that are next due on the note, on the first day of any month prior to <br />maturity: Provided, however, That written notice of an intention to exercise such privilege <br />is given at least thirty (30) days prior to prepayment. <br />2. That the Mortgagor will pay ground rents, taxes, assessments, water rates. and <br />oth e: gv'.er;.~ntal or au.-.ieipal charges, fines, or impositions, for which grovision has <br />not been made hereinbefore, and in default thereof the Mortgagee may gay the same; and that <br />thQ Mortgagor will promptly deliver the official receipts therafc~r to the Mortgagee. <br />
